Prior to the transfer of title of any parcel of property containing
a structure, whether residential, commercial or any other use, the
seller thereof shall be responsible for procuring a zoning certificate
of compliance of said property and structure to assure that the premises
can be properly utilized pursuant to the statutes of the State of
New Jersey and the zoning ordinances of the Township of Liberty.
Said certificate shall provide that the premises is in compliance
with the zoning ordinances of the township and/or is in compliance
with any variances or resolutions granting variances, waivers or subdivisions
pursuant to the ordinances of the township or is a preexisting nonconforming
use. It shall be the responsibility of the seller to provide documentation
relative to the granting of any and all such variances, waivers or
subdivisions.
The Zoning Officer of the township shall, thereafter, review
the application and conduct an inspection of the premises and of relevant
records of the municipality to determine compliance with any and all
terms and conditions of any variances, waivers or subdivisions.
In the event that it is necessary to resort to a survey to determine
compliance, it shall be the responsibility of the seller to provide
appropriate surveys or other evidence so as to afford the Zoning Officer
appropriate information upon which to make a determination.
The seller of such property shall complete the application and
submit the same no later than 15 days prior to the date of anticipated
transfer of title.
The township shall establish, from time to time,
a schedule of fees which will include the fee for the issuance of
the certificate of compliance. Said certificate shall be given to the purchaser of subject
property.
