As used in this chapter, the following terms shall have the
meanings indicated:
BOROUGH
The Borough of Westville, in the County of Gloucester and
State of New Jersey.
CRUISING
The driving of an empty taxicab or limousine to and fro along
a public street or public place at a slow rate of speed for the purpose
of soliciting passengers.
DRIVER
Any person who drives a taxicab or limousine within this
Borough.
LICENSED
Licensed in accordance with the appropriate section of this
chapter.
LIMOUSINE
Any automobile or motorcar used in the business of carrying
passengers for hire which is held out, announced or advertised to
operate or run or which is operated or run over any of the streets
or public highways of this Borough, and which is hired by charter
or for a particular contract, or by the day or hour or other fixed
period, or to transport passengers to a specified place or places,
or which charges a fare or price agreed upon in advance between the
operator and the passenger. Nothing in this definition contained shall
be construed to include taxicabs, hotel buses or buses employed solely
in transporting school children or teachers or autobuses which are
subject to the jurisdiction of the Board of Public Utilities.
OPERATION
Accepting one or more passengers to be transported for hire
in a taxicab or limousine within this Borough or from a point within
this Borough to a point outside the Borough limits. The operation
of a taxicab or limousine in any of the above-described manners by
a person other than the owner shall be deemed operation by the owner
thereof as well as by the person actually driving the same. The transportation
of any person other than the owner or driver in any motor vehicle
bearing a sign therein or thereon using the words "taxi," "taxicab,"
"cab" or "hack" shall be prima facie evidence of operation.
OWNER
Any person, corporation or association in whose name title
to any taxicab or limousine is registered with the New Jersey Department
of Motor Vehicles or who appears in such records to be the conditional
vendee or lessee thereof.
PERSON
Includes a copartnership, association and corporation, and
the singular or plural and the masculine or feminine, unless the contrary
is clearly expressed.
PUBLIC TAXICAB STAND
A section of a public street or of a public place, set apart
for the exclusive use of a taxicab or a limited number of taxicabs
when such section is distinctly marked as such by an appropriate sign
attached to a stanchion on the curb or other conspicuous place or
by clearly visible marks upon the surface of a street or public place.
TAXICAB
Any automobile, motorcar or other motor vehicle commonly
called "taxi," "autocar," "public hack," "omnibus" or by whatever
name or designation any such vehicle may now or hereafter be known
or designated, engaging in the business of carrying passengers for
hire which is held out, announced or advertised to operate or run
or which is operated or run over any of the streets or highways of
the Borough of Westville, in the County of Gloucester, and particularly
into which are accepted and from which are discharged such persons
as may offer themselves for transportation from points or places within
said Borough, upon the terms, provisions or conditions prescribed
in this chapter, or which is hired by charter or by or for a particular
contract, or by the day or hour or other fixed period to transport
passengers to a prescribed place or specified places, or for the use
of which is charged a fare or price agreed upon in advance between
the operator thereof and a prospective passenger therein; provided,
however, that nothing contained in this definition shall be construed
to include any motor vehicle, by whatever name or designation, used
and employed exclusively in transporting school children or school
teachers, or any autobus which is subject to the jurisdiction of the
Board of Public Utility Commissioners.
TAXIMETER
A mechanical instrument or device by which the charge for
hire of a taxicab is mechanically calculated, either for the distance
traveled or for waiting time, or for both, upon which such charge
shall be plainly indicated by means of figures.
From and after the effective date of this chapter, no person
shall operate any taxicab or limousine within this Borough unless
both the taxicab or limousine and the driver thereof are licensed
pursuant to this chapter and conform to all the provisions hereof.
