Borough of Pottstown, PA TRAFFIC REGULATIONS

§ 201 Maximum Speed Limits Established on Certain Streets.

Maximum speed limits are established on portions of specified streets, as follows, and it shall be unlawful for any person to drive a vehicle, on any part of a street where maximum speed limit applies, at a higher speed than the maximum prescribed for that part of the street.

The maximum speed limit on all Borough streets and alleys and other trafficways, not on private property, shall be 25 mph unless noted otherwise as set forth below:

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit.

§ 202 Maximum Speed Limits Established on Certain Bridges and Elevated Structures.

Maximum speed limits are established as follows on certain bridges and elevated structures, and it shall be unlawful for any person to drive a vehicle on any such bridge or elevated structure at a higher speed than the maximum prescribed for that bridge or elevated structure:

§ 203 Maximum Speed Limits Established for Certain Vehicles on Hazardous Grades.

The following are declared to be hazardous grades, and, upon any such hazardous grade, no person shall drive a vehicle, having a gross weight in excess of that referred to for that grade, in the direction stated for that grade, at a speed in excess of that established in this section for that grade, and, if so stated for a particular grade, the driver of every such vehicle shall stop the vehicle before proceeding downhill:

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $35. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 for each mile in excess of five miles per hour over the maximum speed limit.

§ 204 Maximum Speed Limits Established in Parks.

A speed limit of 15 miles per hour is established on all streets and roadways in the public parks maintained and operated by the Borough, except in the following locations, where the lower maximums, as specified, shall apply:

§ 205 Traffic Signals at Certain Locations.

At the following locations, traffic signals as indicated below shall be erected (or are ratified if previously erected), and traffic at those locations shall be directed by those signals:

Any driver of a vehicle who disobeys the directions of any traffic signal shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 206 Intersections Where Turn Prohibited on Red Signal.

The following are established as intersections where drivers of vehicles headed in the direction or directions indicated are prohibited from making a right turn (or a left turn from a one-way street into another one-way street) on a steady red signal:

§ 207 One-Way Streets Established.

§ 208 Turning at Certain Intersections Prohibited or Restricted.

It shall be unlawful for the driver of any vehicle, of the type indicated, traveling upon the first-named street at any of the following intersections, in the direction or directions indicated in each case, to make a left turn and/or a right turn into the second-named street, as indicated, at any time when such a turn is prohibited by this section:

§ 209 Right Turns Only Permitted at Certain Intersections.

It shall be unlawful for the driver of any vehicle traveling upon the first-named street at any of the following intersections, in the direction or directions indicated in each case, to make other than a right turn, at any time stated, both left turns and straight-across traffic being prohibited:

§ 210 U-Turns Prohibited at Certain Locations.

It shall be unlawful for the driver of any vehicle traveling upon any of the following portions of streets, in the direction or directions indicated for that street, to make a U-turn:

§ 211 No Passing Zones Established.

The following are established as no-passing zones, and it shall be unlawful for the driver of any vehicle to overtake or pass another vehicle or to drive on the left side of the roadway in any no-passing zone:

§ 212 Through Highways Established.

The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this section shall stop the vehicle or yield right-of-way as required by § 3323 (b) or § 3323 (c) of the Vehicle Code, as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that section of the law:

§ 213 Stop Intersections Established.

The following intersections (in addition to intersections with the through highways established by § 212) are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the intersecting or through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or stop street, in the direction indicated in each case, shall stop the vehicle as required by § 3323(b) of the Vehicle Code and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

§ 214 Yield Intersections Established.

[Ord. 1735, 4/12/1993]

The following intersections (in addition to intersections with the through highways established by § 212) are established as yield intersections, and official yield signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the through street) on the first-named street (the yield street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or yield street, in the direction indicated in each case, shall slow down or stop the vehicle as required by § 3323(c) of the Vehicle Code and then yield the right-of-way as required by that subsection of the Vehicle Code.

§ 215 Operation of Motor Vehicles Restricted on Public Lands.

No motor vehicle, including a motorcycle, pedalcycle or minibike, shall be operated on any property owned by the Borough or any other public agency or instrumentality within the Borough without the permission of the property owner and a permit from the Borough Manager or other designated official of the Borough.

Any person who violates any provision of this section shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 216 Rotary Traffic Islands Established.

[Ord. 1735, 4/12/1993]

The following locations are designated as rotary traffic islands, and every vehicle passing around a rotary traffic island shall be driven only to the right of the island:

Any person who drives a vehicle otherwise than to the right of any rotary traffic island shall be guilty of a violation of this section, and, upon conviction, shall be sentenced to pay a fine of $25 and costs.

§ 217 Play Highways Established and Authorized. [1]

The following areas upon the streets in the Borough are established as play highways:

The Borough Manager, on the recommendation of the Recreation Director, is authorized to designate as play highways, whenever he deems that action advisable, and for whatever period of time directed by him, any part of any street in the Borough, where sledding and coasting, shall be permitted. That play highway shall be set apart for the purpose under the direction of the Borough Manager.

No person shall drive any motor vehicle upon any play highway at any time when that street shall be designated as a play highway, except in case of emergency, with special permission of the Borough Manager or of the police officer in charge, who shall first clear that play highway of all persons using it for the purpose for which it was set aside. Any person who violates any provision of this subsection shall, upon conviction, be sentenced to pay a fine of $25 and costs.

§ 218 Snowmobile Roads Designated.

The following roads and streets within the Borough are designated as special snowmobile roads:

It shall be unlawful for any person to operate a snowmobile on any highway, street or road in the Borough other than as provided above, provided that nothing in this section shall prohibit any person from operating a snowmobile on any other street in the Borough:

As authorized by § 7721 of the Vehicle Code for emergency and bridge crossings and for direct crossing of streets or two-lane highways; or

For special snowmobile events where authorized in advance and the street is blocked off as provided in § 7723 of the Vehicle Code. Any person who violates any provision of this section shall be subject to the penalties prescribed in § 7752(a) of the Vehicle Code.

§ 219 Streets Closed to Vehicular Traffic During Certain Times.

No person shall operate a motor vehicle on the following streets or portions thereof during the times specified:

§ 220 Conduct in or on a Motor Vehicle Parked Upon a Public Street and Public Parking Lot.

[Ord. 1843, 12/30/1996, § 11]

No person shall sit, lie, recline, rest or lean against or upon any part of a motor vehicle, including but not limited to its hood, roof or trunk, parked upon a public street or in a public parking lot. No person shall occupy any motor vehicle with part of their body, including but not limited to their arms and legs, extending from the said vehicle while the vehicle is parked upon a public street or in a public parking lot.

Any person who shall violate any provision of this section shall, upon summary conviction before a District Magistrate, be sentenced to pay a fine of $25 and costs of prosecution and, in default of payment thereof, shall undergo imprisonment in the County Jail for not more than five days.

§ 221 Pedestrian Standing or Sitting on Public Roadways or Parking Lanes.

No person shall stand or sit on a public highway or in a parking lane of a public highway for purposes other than immediate ingress or egress to a lawfully parked motor vehicle.

§ 222 Parking in Excess of Five Days After Notice Unlawful.

[Ord. 1843, 12/30/1996, § 13]

It shall be unlawful for any person to park a vehicle upon any of the streets or alleys of the Borough and to allow the same to remain parked in the same location for five consecutive days after the date of notice is sent, by certified mail, to the last registered owner of the vehicle. Failure to comply shall result in the vehicle's removal to a designated storage facility, where it may be redeemed by the owner in accordance with the provisions of the Vehicle Code of the Commonwealth of Pennsylvania, Act of June 17, 1976, effective July 1, 1977. If the motor vehicle does not bear an identifiable registration plate, then notice may be secured to the vehicle. Within the five-day period, the owner shall have the opportunity to explain to the designated police authority why the vehicle should not be moved. If the owner's reasons are without legal merit, the owner shall be given an additional 48 hours to remove the vehicle from the street or alley. Any person violating any provision of this section shall, upon issuance of a summary conviction, be fined $25 and the costs of prosecution in accordance with § 6502 of the Pennsylvania Motor Vehicle Code.

§ 223 Parking of RV's and Camping Equipment in Public Parking Lots Prohibited.

It shall be unlawful to park and permit to remain parked overnight (9:00 p.m. to 6:00 a.m.) in any public parking lot, as defined in Part 6 of this chapter, any RV (recreational vehicle), motor home, camping trailer, or similar type vehicle. Any person violating any provision of this section shall, upon issuance of a summary conviction, be fined not less than $50, and the costs of prosecution, and, in default of payment thereof, shall undergo imprisonment in the County Jail for not more than five days.

§ 224 Driving in or on Designated Bike Lanes and Two-Way Cycle Tracks.

No motor vehicle, including a motorcycle, motorized scooter, licensed motorized pedalcycle or minibike, shall be operated in or on any designated bike lane or two-way cycle track which is marked with painted lines, physical lane delineators and/or appropriate signage.
