There has been an increasing demand for emergency rescue services
from the Fire Department. The purpose of this article is to establish
standards and fees to recover some of the cost incurred by the municipality
in providing these services, including the cost of specialized training
and equipment.
As used in this article, the following terms shall have the
following meaning unless the context clearly indicates that a different
meaning is intended.
EMERGENCY RESCUE SERVICES
Includes the extrication of a person from a dangerous situation
by the use of any specialized equipment.
EMPLOYER
Includes a natural person, association, corporation, limited-liability
company, partnership, trust or other legal entity.
RECIPIENT OF SERVICE
Includes a person extricated from a dangerous situation.
It also includes the employer of said person acting in the course
of his or her employment at the time of the emergency rescue incident.
TECHNICAL RESCUE INCIDENT
Includes any incident which requires a confined space rescue,
high angle rescue, machinery extrication rescue, rope rescue, structural
collapse rescue, trench rescue or water and ice rescue.
Emergency rescue services shall be reimbursable whenever Fire
Department vehicles and equipment respond to an emergency rescue incident
and perform emergency rescue services.
Any recipient of the services specified herein shall provide
the Fire Department with the following information:
A. His or her name, address and telephone number.
B. The name, address and telephone number of his or her insurance carrier,
if applicable.
C. If the recipient of the service is an employee acting in the course
of his or her employment at the time of the emergency rescue incident,
then the recipient shall provide the name, address and telephone number
of his or her employer.
The following fees are hereby established for reimbursable services
rendered by the Fire Department. Fees for incidents involving multiple
vehicles are established herein on a per-vehicle basis.
A. Light rescue.
(2) Light rescue operations shall include, but not be limited to, removal
of possible fire hazards, fluid control, vehicle stabilization, use
of hand tools and other scene-related light rescue activities.
B. Medium rescue.
(2) Medium rescue operations shall include, but not be limited to, the
use of power tools and hydraulic rescue tools to perform activities
such as opening or removing doors to provide access to patients, stabilizing
vehicles and performing hazardous assessments.
C. Heavy rescue.
(2) Heavy rescue operations shall include, but not be limited to, any
technical rescue procedures such as confined space rescue, high angle
rescue, machinery extrication rescue, rope rescue, structural collapse
rescue, trench rescue or water and ice rescue.
(3) Heavy rescue operations shall include a motor vehicle rescue where
the rescue includes the use of power tools and hydraulic equipment
to perform operations such as partial or full roof removal, front/dash
displacement, third door access and separating vehicles from one another.
The Fire Department and the Chief Financial Officer shall establish
a third-party billing system to collect the fees set forth herein.
Fees for emergency rescue services shall be billed to the recipient
of the service, his or her insurance carrier, or his or her employer,
if applicable.
The Fire Department has the duty to respond to all emergency
rescue incidents, notwithstanding the inability of the recipient of
the service to pay for the service or the lack of insurance. The Fire
Department shall not delay or refuse any emergency rescue service
to any person based on the inability to pay for the service or lack
of insurance.
