No person under 18 years of age shall be or remain in or upon
any of the public streets, alleys or public grounds in the Township
of Kingston at night after the hour of 10:00 p.m., unless such person
is accompanied by a parent, guardian or other person having the legal
custody of such minor person; or such minor person is in the performance
of an errand or duty directed by such parent, guardian or other person
having the care or custody of such minor person, or whose employment
makes it necessary to be upon the streets, alleys or public grounds
of the Township during such time. This exception shall not apply when
the person under such age is playing or unnecessarily loitering in
or upon the streets, alleys or public grounds, whether alone or accompanied
by a parent, guardian or any other person.

No child or minor person arrested under the provisions of this
Part shall be placed in confinement until the parent or guardian of
such person has been notified of such arrest and has refused to be
held responsible for such actions of such minor.

No parent, guardian or other person having legal care or custody
of any person under 18 years of age shall allow or permit any such
child, ward or other person under such age while in such legal custody,
to go or be in or upon any of the streets, alleys or public grounds
of the Township within the time prohibited in the preceding section,
unless reasonable necessity exists therefor.

Any person under the age of 18 years who shall violate any provision
of this Part shall be considered a delinquent and the Police Department
of the Township of Kingston is hereby empowered to commence all necessary
legal proceedings against such delinquent minor in the form and in
the manner as provided by the law relating to delinquent minors. This
provision shall not apply unless the parent or guardian of such minor
person has refused to be held responsible for such actions of such
minor.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a district justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each Section of this Part which shall be found to have been violated
shall constitute a separate offense.
