As used in this article, the following terms
shall have the meanings indicated:
SETBACK AREA
That portion of a lot or plot between the street line and
the setback lines established under this Zoning Ordinance of the Village
of Farmingdale and the Zoning Map referred to herein.
Except as permitted under the provisions of §§
600-199 and
600-200 of this article, no building or structure shall hereafter be erected, nor shall any building hereafter be reconstructed, extended or structurally altered, so as to encroach upon the setback area of any lot or plot within the Village of Farmingdale, nor shall such building or structure extend in, over or upon such setback area.
Whenever any building shall project into a setback
area established under this Zoning Ordinance of the Village of Farmingdale
and such building shall be destroyed by fire or other casualty to
the extent of not more than 50% of its value and that portion of the
building extending into the setback area shall be destroyed to the
extent of not more than 50% of its value, such building may be reconstructed
and used in the same manner as existed prior to destruction by fire
or other casualty.
The Board of Trustees shall have the power to
grant a permit for the erection of a temporary structure within the
whole or portion of the setback area where the use thereof is accessory
to the use of the main building and where there are buildings erected
upon plots on each side of the setback area and which do not conform
to the provisions of this chapter. Such temporary permits shall be
terminable by the Board of Trustees whenever the Board of Trustees
or other municipal body having jurisdiction shall elect to widen the
street or highway upon which the lot or plot abuts or whenever the
building or buildings on either or both sides of said lot or plot
shall be rebuilt or altered so as to conform to the provisions of
this chapter.
