1. The following definitions are established and apply to this Part
3:
FIRE LANE
That portion of any land posted with an official sign or
designated as defined in § 303 of this Part. A fire lane
shall be 20 feet in width, measured from the place at which the official
sign or designation is placed; and where any such sign or designation
is placed at, near or alongside a highway, road, street, accessway,
alley or the like (hereinafter referred to as "roadway"), the fire
lane shall extend 20 feet therefrom onto and into the roadway.
IMPEDIMENT
Any object that may obstruct firefighting equipment.
VEHICLE
Every device in, upon or by which any person or personal
property is or may be transported or drawn upon land, except devices
used exclusively upon rails or tracks, including, but without limiting
the generality of the foregoing, automobiles, trucks, motorcycles
and bicycles.
2. As used herein, the singular shall include the plural, and the plural,
the singular.

No person at any time shall place an impediment on or park or
leave standing any vehicle (whether the driver remains in the vehicle
or not) or otherwise obstruct any fire lane established pursuant to
this Part.

Official signs shall be placed along the said fire lane, which
signs shall read: "FIRE LANE — PARKING OR STOPPING
OF VEHICLES PROHIBITED" (hereinafter referred to as "designation").
Said designations shall be placed at intervals no greater than 50
feet. In lieu of signs as defined herein, the aforesaid designation
may be painted on the curb or roadway. The occupant of the property
or, in the case of unoccupied property, the owner of the unoccupied
property is hereby required to and is responsible for the proper posting
of the aforesaid designations.

The North Strabane Township Volunteer Fire Department or its
designated official shall have the power to designate fire lanes anywhere
within the Township, on public or private property, where it deems
that vehicles or impediments may impede the free movement of firefighting
and other emergency equipment.

1. Any person, firm or corporation who shall violate any provision of
this Part, upon conviction thereof in an action brought before a District
Justice in the manner provided for the enforcement of summary offenses
under the Pennsylvania Rules of Criminal Procedure, shall be sentenced
to pay a fine of not more than $1,000, plus costs and, in default
of payment of said fine and costs, to a term of imprisonment not to
exceed 90 days. Whenever any person violating any of the provisions
of this Part is notified of such violation, in writing, by the Township
Manager, each day that a violation of this Part continues or each
section of this Part which shall be found to have been violated shall
constitute a separate offense.
2. In addition to and not in lieu of the foregoing, the Township may
seek equitable and legal relief to compel compliance with this Part.

This Part 3 shall be enforced by any member of the Township
Police Department or the Fire Officers of the North Strabane Township
Volunteer Fire Department or the Township Manager or any other person
designated by resolution of the Township Board of Supervisors at any
public meeting (hereinafter referred to as "enforcement officers").

Any enforcement officer may, upon presenting proper credentials,
at all reasonable hours, enter any private property for the purpose
of making any inspection or investigation which he deems necessary
to be made to determine conformity to the provisions of this Part
or to instruct the occupant of the property or, if the property is
unoccupied, the owner of the unoccupied property to place, erect or
paint designations referred to in § 303 or to investigate
conditions liable to interfere with the free movement of firefighting
and other emergency equipment or endanger life or property (hereinafter
generally referred to as "entry"), provided permission is obtained
from the occupant or, in the case of unoccupied property, from the
owner, lessee or his agent. If such permission is refused or is otherwise
unobtainable, a search warrant shall be obtained prior to entry or
inspections, except in the case of an existing emergency deemed immediately
necessary to protect life or property.
