There is hereby adopted by the Township of Upper Moreland, copies of which are on files in the office of the Township Manager, 117 Park Avenue, Willow Grove, Pennsylvania, that certain code for regulating, among other things, the design, construction, installation, maintenance and repair of plumbing systems, known as the "International Plumbing Code," 2000 Edition, as published by the International Code Council, and the whole thereof, save and except such portions as are hereafter deleted, modified or amended.
A. 
101.1 TITLE shall be amended by the insertion of the words "Township of Upper Moreland" for the name of the jurisdiction.
B. 
103 DEPARTMENT OF PLUMBING INSPECTION shall be amended to have the term "Department of Plumbing Inspection" replaced wherever it appears by the term "Department of Code Enforcement."
C. 
Subsection 106.6 Fees shall be amended as follows:
106.6.2 Fee schedule. The fees for permits for all required under this code shall be as set forth in the fee schedule established in Chapter 140, Fees, Rates and Permits, of the Township Code of Upper Moreland Township.
106.5.3 Fee Refunds. The code official shall be authorized to refund fees upon the written request of the applicant, made not later than 30 days after the issuance of the permit, as follows:
1.
The full amount of any fee paid hereunder which was erroneously collected for work not requiring a permit or plan review.
2.
The full amount, less a handling charge of 25% of the amount of the permit fee, but not less than $10, when no work is done under a permit which the applicant wishes to have withdrawn after issuance.
D. 
Subsection 107.3 Testing shall be amended to read as follows:
107.3 Testing. Plumbing work and systems shall be tested as required in Section 312 and in accordance with Sections 107.3.1 through 107.3.3. Tests shall be made by the permit holder and observed by the code official. It shall be the duty of the permit holder to give 24 hours' advance notice to the Department when the work is completed and ready for inspection and testing.
E. 
Section 108 VIOLATIONS shall be amended to read as follows:
(1) 
Subsection 108.3 Prosecution of violation shall be amended to read as follows:
108.3 Prosecution of violation. Any person who shall violate any provision of this code, or who shall fail to comply with any of the requirements hereof, or who shall fail to correct in the time provided by this code the defects for which the dwelling or dwellings have been cited, shall be guilty of a summary offense, which shall be deemed to be a strict liability offense and shall, upon summary conviction before a magisterial district judge, pay a penalty of not less than $100 or more than $1,000 and, in default of payment of such fine, be imprisoned for not less than one day or more than 30 days. Each day that a violation continues or that a person shall fail to comply with any provision, after notification by the Department of Code Enforcement, shall constitute a separate violation, subject to a separate offense punishable by a like fine or penalty.
(2) 
Subsection 108.4 shall be deleted.
(3) 
Subsection 108.5 STOP-WORK ORDER shall be amended to read as follows:
108.5 Stop-work orders: Upon notice from the code official that mechanical work is being done contrary to the provisions of this code or in a dangerous or unsafe manner, such work shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, the owner's agent or to the person doing the work. In an emergency, the code official shall not be required to give written notice prior to stopping the work. Any person who shall continue any work on the system after receiving a stop-work order, except such work as that person has been directed to perform by the Code Official to remove a violation or correct an unsafe condition, shall be in violation of the terms of this code and liable to a fine as provided in Sec. 108.4 hereof.
F. 
Sec. 109 MEANS OF APPEAL shall be amended as follows:
(1) 
Subsection 109.2 Membership of the Board shall be amended to read as follows:
109.2 Membership of the Board: The Board of Appeals shall consist of the Board of Commissioners of the Township or such persons as the Board shall designate to hear the appeal.
(2) 
Subsections 109.2.1 through 109.2.6 are hereby deleted.
(3) 
Subsection 109.6 Board decision shall be amended to read as follows:
109.6 Board decision: The Board of Appeals shall render its decision by a majority vote of a quorum of the Board.
(4) 
Subsection 109.7 Court review shall be amended to read as follows:
109.7 Court review: Any person aggrieved by the decision of the Board of Appeals shall have the right to appeal such decision in compliance with the provisions of the Local Agency Law, 2 Pa.C.S.A. § 101 et seq.
G. 
A new Section 110 REGISTRATION AND LICENSE OF PLUMBERS shall be added, reading as follows:
110 REGISTRATION AND LICENSE OF PLUMBERS
110.1 Master Plumber's License
110.1.1 No person shall engage in the business or practice of plumbing or act as a plumber unless such person has obtained a master plumber's license from the Department, as hereafter provided, except that this requirement shall not prohibit the employment of:
1.
Journeymen plumbers licensed in accordance with Section 110.3 hereof, when employed under the direction and supervision of a licensed master plumber; or
2.
Apprentice plumbers registered in accordance with Section 110.4 hereof, when employed under the direction and supervision of a licensed master plumber or licensed journeyman plumber.
110.1.2 No license for a master plumber shall be issued unless the applicant for such license shall meet the following conditions:
1.
Have a bona fide place of business so as to be available for supervision and consultation by the Department during the working day; and
2.
Have passed the examination on the theory and practice of plumbing prescribed by the Department and administered to applicants on behalf of the Department by a duly authorized testing body; and
3.
Has paid the annual license fee as established in Chapter 140, Fees, Rates, and Permits, of the Upper Moreland Township Code; and
4.
Complies with the insurance requirements of Chapter 119, Licensing of Contractors, of the Upper Moreland Township Code.
110.1.3 Any licensed master plumber shall be entitled to a renewal of his license annually upon payment of the annual license fee as established in Chapter 140, Fees, Rates, and Permits, of the Upper Moreland Township Code and proof of compliance with the insurance requirements of Chapter 119, Licensing of Contractors, of the Upper Moreland Township Code.
110.2 Restricted Master Plumber's License.
110.2.1 A restricted master plumber's license may be issued to persons employed by an institution to perform plumbing work within such institution and not to the general public.
110.2.2 No license for a restricted master plumber shall be issued unless the applicant for such license shall meet the following conditions:
1.
Be employed exclusively by a public or private institution; and
2.
Have passed the master plumber's examination on the theory and practice of plumbing prescribed by the Department and administered to applicants on behalf of the Department by a duly authorized testing body; and
3.
Such institution shall have paid the annual license fee as established in Chapter 140, Fees, Rates, and Permits, of the Upper Moreland Township Code.
110.3 Journeyman Plumber's License.
110.3.1 No person shall engage in the business or practice of plumbing in the capacity of a journeyman plumber unless such person has obtained a journeyman plumber's license from the Department, as hereafter provided.
110.3.2 No license for a journeyman plumber shall be issued unless the applicant for such license shall meet the following conditions:
1.
Is at least 18 years of age; and
2.
Have bona fide employment by a licensed master plumber for supervision during the working day; and
3.
Have passed the journeyman's examination on the theory and practice of plumbing prescribed by the Department and administered to applicants on behalf of the Department by a duly authorized testing body; and
4.
Has paid the annual license fee as established in Chapter 140, Fees, Rates, and Permits, of the Upper Moreland Township Code.
110.4 Registration of Apprentice Plumbers
110.4.1 No person shall engage in the business or practice of plumbing in the capacity of an apprentice plumber unless such person has been registered with the Department, as hereafter provided.
110.4.2 No apprentice plumber shall be registered unless the applicant for such registration shall meet the following conditions:
1.
Is at least 16 years of age; and
2.
Have bona fide employment by a licensed master plumber for supervision during the working day; and
3.
Has paid the annual license fee as established in Chapter 140, Fees, Rates, and Permits, of the Upper Moreland Township Code.
110.5 Issuance of Licenses
110.5.1 The Department may fix the license year on a calendar-year or any other twelve-month basis, as it deems desirable for efficient administration and for the convenience of the public, but if a license year is changed, any person holding a license shall receive credit for the unexpired term.
110.5.2. Master plumbers' licenses shall be conspicuously displayed in the bona fide place of business of the licensee or in such other place or manner as the Department may prescribe.
110.5.3 All licenses shall be nonassignable and nontransferable.
110.5.4 All licenses shall be conditioned upon continued compliance with this chapter and the regulations issued hereunder.
110.6 Revocation of Licenses
110.6.1 Whenever the Department determines that any licensed plumber has violated any condition of his license, it shall serve written notice upon the licensee stating the nature of the violation and a period of time in which to demonstrate or achieve compliance with all lawful requirements of his license.
110.6.2 If at the expiration of the time afforded for compliance the violation has not been corrected, the Department may revoke the license forthwith.
110.6.3 Revocation of a license shall not be effective while an appeal from such revocation is pending as provided for in Section 109.
110.7 Bond. A person who has been issued a master plumber's license shall execute and deposit with the Township a bond in the sum of $1,000, such bond to be conditioned that all plumbing work performed by the licensee, or under his supervision, shall be performed in accordance with the provisions of this code, and that he will pay all fines and penalties properly imposed upon him for violation of the provisions of this code. A master plumber's license shall not be valid unless a bond is executed and deposited as herein provided.
