The Fire Marshal of Upper Moreland Township shall have the power to restrict and regulate the parking of motor vehicles in areas adjacent to commercial buildings, multiple-dwelling buildings and other buildings open to the public where such restriction and regulation is necessary in order to provide adequate ingress, egress and operation of fire equipment and other emergency vehicles. The restricted and regulated areas hereinafter being referred to as "fire zones."
A. 
Temporary regulations. The Fire Marshal is hereby given authority to adopt and enforce temporary parking regulations to cover emergencies or special conditions on any private street, lane, alley or driveway, or on any shopping center, educational, institutional, apartment complex, or similar occupancy if the Fire Marshal shall determine that the parking of motor vehicles is liable to interfere with the operations of the Fire Department or seriously hamper the egress of occupants from a building in case of fire. In exercising the authority provided in this subsection, the Fire Marshal shall post signs reading "No Parking – Temporary Fire Regulation – By Order of the Fire Marshal of Upper Moreland Township."
No person shall park or leave unattended any motor vehicle in an area designated a fire zone when an official sign designating such zone is erected.
The owners of property in which fire zones are located shall be responsible for the erection or construction of the official signs or appropriate markings in accordance with specifications outlined by the Fire Marshal when the Board of Commissioners by resolution has authorized and approved such designation. Said owners shall thereafter be responsible for the proper maintenance and upkeep of the signs or markings.

A. 
Any person owning or operating a motor vehicle in violation of the provisions of this article or any regulation enacted thereunder shall be issued a Township notice of violation by the Upper Moreland Police Department or Fire Marshal, imposing a fine of $20. Should the offender fail to pay the fine or challenge the notice of violation, the notice of violation will be rescinded and a nontraffic citation will be filed with the Township Magisterial District Judge. Upon summary conviction before a Magisterial District Judge, the offender shall be sentenced to pay a fine of no less than $10 nor more than $50 plus costs of prosecution and the Township's actual attorneys' fees. Failure to pay any fines, costs and fees imposed may result in imprisonment not to exceed 30 days.

B. 
Any owner of property found to be in violation of the provisions of § 153-10 shall be issued a Township notice of violation by the Upper Moreland Police Department, imposing a fine based on the quantity of notices of violation the person has been issued for the particular violation, in accordance with the amounts set forth in Chapter A370. Should the offender fail to pay the fine or challenge the notice of violation within five days of the date of issuance, the Police Department will rescind it and file a non-traffic citation with the Township Magisterial District Judge. Upon summary conviction before a Magisterial District Judge, the offender shall be sentenced to pay a fine of no less than $100 nor more than $1,000 for each violation plus costs of prosecution and the Township's actual attorney's fees. Each day that a violation continues shall be deemed to be a separate offense. Failure to pay any fines, costs and fees imposed may result in imprisonment not to exceed 30 days.
