The reduction of the amount of solid waste and conservation of recyclable materials is an important public concern because of the growing problem of solid waste disposal and its impact on the environment. The collection of recyclable materials from residences in the Township will serve the interest of the general public and will result in a financial benefit to the residents and taxpayers of the Township by reason of the income realized from the sale of these recyclable materials. Collection regulations must be established to implement the program, facilitate the accomplishment of its objectives and to encourage the fullest possible citizen participation.
Unless the context clearly indicates otherwise, the following words and phrases used throughout this article shall have the following meanings:
ALUMINUM BEVERAGE CAN
A can made of exclusively the metal aluminum or any of its alloys but not combined with any other metal part, such as an aluminum top combined with a steel or bimetal body.
BIMETAL FOOD CONTAINER
A food container commonly known as a "tin can," consisting of a tin-plated sheet steel cylinder used for food preservation.
CLEAN AND UNCONTAMINATED NEWSPAPER
Newspaper which has not been exposed to substances or conditions rendering it unfit for recycling purposes.
GLASS
All products made from silica or sand, soda ash and limestone, the product may be transparent, translucent, or colored, and may be used as a container for packaging or bottling of various matter, and all other material commonly known as "glass," but not including any plate or window glass or lead crystal glass.
NEWSPAPER
Paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest.
PERSON
Includes a lessee as well as an owner of a residence, and includes a person, firm or corporation which owns a residence.
RECYCLABLE MATERIAL
Aluminum beverage cans, bimetal food containers, glass, and clean and uncontaminated newspapers.
RESIDENCE
Any single-family or other dwelling from which the Township collects solid waste.
SOLID WASTE
All garbage and refuse normally placed by a resident for regular collection by the Township.
TOWNSHIP
The Township of Upper Moreland.
The Township hereby establishes a mandatory program for the separate collection of recyclable materials from all residences in the Township of Upper Moreland for which garbage and rubbish collection is provided by the Township. Collection thereof shall be made periodically by the Township for recycling purposes.
The Superintendent of the Public Works Department is hereby authorized and empowered to establish and promulgate regulations on the manner, days and times of collections of recyclable materials, and the bundling, handling, location and time of placement of such materials for collection.
All persons who are residents of the Township shall separate all recyclable materials from all other solid waste produced at their residence, and shall place such recyclable materials for collections by the Township in accordance with the regulations established hereunder. The duty to comply with these regulations shall be and is hereby imposed upon the owner or owners of record of any property ("record owner"), as reflected by the tax duplicate prepared by the Board of Assessment of Montgomery County, as updated from time to time. In the event that the record owner is a lessor of the property, it shall be the duty of such lessor to inform the lessee of the various requirements of these regulations, as amended from time to time, by an appropriate provision in the lease agreement, by posting a copy of this article in the property, or otherwise in any fashion reasonably designed to provide actual notice of such regulations, and it shall be the duty of the record owner as lessor to cause the lessee to conform to the requirements of these regulations.
All separated recyclable materials placed by the resident for collection by the Township pursuant to this article and regulations hereunder shall, from the time of placement, become the property of the Township.
It shall be a violation of this article for any person, firm or corporation other than the Township or one authorized by the Township to collect recyclable materials placed by a resident for collection by the Township, unless such person, firm or corporation has prior written permission to make such collection. Each unauthorized collection in violation hereof from one or more residences on one calendar day shall constitute a separate and distinct offense.
Any resident may donate or sell recyclable material to any person, firm or corporation, whether operating for profit or not, provided that the receiving person, firm or corporation shall not collect such donated or solid waste from the collection point of a residence without prior written permission from the Township to make such collection.
A. 
Any person, firm or corporation who shall violate the provisions of § 279-20 shall receive an official written warning of noncompliance for the first and second offense. Thereafter, all such violations shall be subject to the penalties hereinafter provided.
B. 
Except as hereinbefore provided, any person, firm or corporation who shall violate any of the provisions of this article shall, upon conviction, be sentenced to pay a fine of not less than $100 nor more than $1,000 and costs of prosecution for each and every offense or, in default of payment of such fine and cost, to undergo imprisonment for not more than 30 days for each violation.
