The discharge and/or mechanical pumping of domestic wastewater by residents, occupants and/or property owners in Upper Macungie Township and upon Township roads and streets shall be totally prohibited.

Any person (resident, occupant and/or property owner) who shall violate this Part and who, by discharging and/or mechanically pumping domestic wastewater in and upon Township roads and streets during subfreezing weather conditions creates icy streets and road conditions thereby, shall, upon conviction before any magistrate or justice of the peace having jurisdiction in Upper Macungie Township, be sentenced to reimburse Upper Macungie Township for the costs incurred by said Township for the removal of such icy conditions from such road or street for each and every such offense.

Any person (resident, occupant and/or property owner) who shall violate this Part and/or who, by discharging and/or mechanically pumping domestic wastewater in and upon Township roads and streets during subfreezing weather conditions creates icy streets and road conditions thereby, shall, upon conviction before any magistrate of justice of the peace having jurisdiction in Upper Macungie Township, in addition, be sentenced to pay a fine of not more than $300 and/or to imprisonment for a term not to exceed 90 days.

In addition to any other remedies provided in this Part, any violation of § 21-401 above shall constitute a nuisance and may be abated by the Township by either seeking appropriate equitable or legal relief from a court of competent jurisdiction.
