Where, in the case of a particular proposed subdivision, it
can be shown that strict compliance with the requirements of this
chapter would result in a need for variance or exception because of
unusual topography, or impose unreasonable burdens, or that these
conditions would result in inhibiting the achievement of the objectives
of these regulations, the Planning and Zoning Commission may vary,
modify, or waive the requirements. No variance shall be allowed when
such variance is requested because of inadequate drainage.
Application for any variation shall be submitted, in writing,
by the subdivider at the time the preliminary plat is filed, and shall
state fully the grounds for the application and the facts relied upon
by the subdivider.
In no case shall any variation or modification be contrary to
the mandatory requirements of state law. The variation shall not be
in conflict with any zoning ordinance and map.
Final approval of variances granted by the Planning and Zoning
Commission rest with the City Council.
Specifications or supplementary data required by these regulations
for a preliminary or final plat may be waived whenever such specifications
or data are determined by the City Planning and Zoning Commission
to be unnecessary for the consideration of the plat.
