There is established a Legal Department, the Director of which
shall be the Borough Attorney.
The Borough Attorney shall be appointed by the Mayor, with the
advice and consent of the Municipal Council, to serve during the term
of the Mayor. The Borough Attorney may be practicing law as individuals
or as members or associates of a law firm; however, the Borough Attorney
must have been admitted to practice as an attorney at law of the State
of New Jersey for a period of not less than 10 years.
The Borough Attorney, in addition to other duties, functions
and powers as may be otherwise delegated to him, shall:
A. Be the chief legal advisor to the Municipal Council, Mayor, Business
Administrator and Clerk and shall give all necessary legal advice
and counsel as required for the Borough, its department heads, officers
and employees.
B. Prepare all ordinances, regulations, resolutions, contracts and other
legal documents and papers for and on behalf of the Borough.
C. Examine and approve as to form and sufficiency all performance and
maintenance bonds, insurance certificates or any other documents requiring
legal review submitted by developers, contractors or other persons
required by general law to file the same with the Clerk, Treasurer,
Planning Board or Board of Adjustment.
D. Represent the Borough in all appeals and proceedings involving the
assessment of real property or collection of taxes, assessments or
water charges.
E. Appear as attorney of record for the Borough in all actions or proceedings
in which it may be or become involved.
F. Attend all regular meetings of the Municipal Council and all conferences
or other meetings of the Council as may be requested by it.
The Borough Attorney shall receive an annual salary as established by the Salary Ordinance and shall receive such further compensation for particular services upon submission of vouchers through the Department of Finance in the manner provided in Chapter
75 of the Code.
