As used in this chapter, the following terms shall have the
meanings indicated:
LIMOUSINE
The same definition as set forth in N.J.S.A. 48:16-13.
Every owner of a limousine having his principal place of business
in the Borough of Hawthorne shall make application to the Clerk of
the Borough of Hawthorne, on such form as may be prescribed by the
Clerk, for a license to operate such limousine.
Every limousine owner making application for a license to the
Borough Clerk shall file with the Clerk at the time of the filing
of the application for a license the required insurance certificate
as set forth in N.J.S.A. 48:16-14 as well as power of attorney as
set forth in N.J.S.A. 48:16-16.
The application submitted by the applicant, in addition to insurance
and power of attorney requirements set forth above, shall be on such
form as prescribed by the Borough Clerk and contain therein the following
information sworn to or affirmed by the applicant:
A. The year, make, model and vehicle identification number, license
plate and color of each vehicle.
B. The name and address of the insurance company and policy name.
C. The principal place of business of the limousine owner.
D. The home address and business address of the limousine owner.
E. Proof that the limousine is equipped with all equipment prescribed
by N.J.S.A. 48:16-22.1.
F. A statement as to whether or not the applicant has ever been convicted
of a crime, and if the applicant has been convicted of a crime, a
complete statement concerning dates and disposition thereof. In the
case of a corporate applicant, the statement shall be completed as
to each officer, director or shareholder having an ownership interest
of more than 10% in the entity.

The application shall be accompanied by a fee as set forth in Chapter
220, Fees.
In addition to the foregoing, the applicant shall present each
vehicle for licensing to the Chief of Police or his designee for inspection
so as to ensure compliance with N.J.S.A. 48:16-22.1.
Upon approval of the license, including receipt of the required
proof of insurance, power of attorney and fee, as well as inspection
of the vehicle by the Chief of Police, the Clerk shall issue a license
to the applicant, which shall remain valid for a period of one-year
commencing on the first day of the month in which the approval shall
have been granted.
The license issued hereunder shall remain in effect only for
the period that the insurance described in the certificate filed with
the Borough Clerk remains in full force and effect and the registration
issued by the New Jersey Division of Motor Vehicles remains valid
and in effect.

Any person who violates any provision of this chapter shall,
upon conviction, be subject to a fine of not more than $2,000 or imprisonment
of not more than 90 days, or both.
