For the purpose of this chapter, the following terms, phrases,
words and their derivations shall have the meanings stated herein
unless their use in the text of this chapter clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
CONTAINERIZED
The placement of vegetative yard waste in a trash can, bucket,
paper bag or other vessel, other than any plastic bag, such as to
prevent the yard waste from spilling or blowing out into the street
and coming into contact with stormwater.
LEAF SEASON
That period of time, as determined by the Borough of Hawthorne
and published annually, designated as leaf pickup season.
PERSON
Any individual, corporation, company, partnership, firm,
association, or political subdivision of the state subject to municipal
jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive,
or other way, which is an existing state, county, or municipal roadway,
and includes the land between the street lines, whether improved or
unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas, and other areas within the street lines.
The Borough shall provide for the pickup and disposal of containerized vegetative yard waste, in reasonable amounts and generated within the Borough of Hawthorne, on such days and in such manner as may be designated for collection. Notice of any regulation pertaining to the manner of pickup and schedule therefor shall be provided in a manner substantially similar to the provisions of §
376-2B.
Sweeping, raking, blowing or otherwise placing yard waste that
is not containerized at the curb or along the street is only allowed
during the seven days prior to a scheduled and announced collection,
and shall not be placed closer than 15 feet from any storm drain inlet.
Placement of such yard waste at the curb or along the street at any
other time or in any other manner is a violation of this chapter.
If such placement of yard waste occurs, the party responsible for
placement of the yard waste must remove the yard waste from the street
or said party shall be deemed in violation of this chapter.
A. Containerized leaves placed in receptacles or in paper bags specifically
designed for such purpose will be collected at the curb on a weekly
basis and in accordance with a schedule established for pickup by
the Administration.
B. Leaves may be transported to the recycling center and deposited into
the receptacle made available for such purpose.
C. Leaves may be placed in the street for collection by the Borough
during leaf pickup season, in accordance with a schedule to be established
by the Administration and subject to the following limitations:
(1) No leaves may be placed in the street or along the curb sooner than
three days preceding or the weekend preceding the scheduled pickup
date.
(2) No leaves may be placed nearer than 15 feet from any storm sewer
inlet.
(3) Leaves may not be placed upon any road or street in such area or
manner where the same would constitute a public nuisance or danger.

The owner or occupant of any property, or any employee or contractor of such owner or occupant engaged to provide lawn care or landscaping services shall not sweep, rake, blow or otherwise place yard waste, unless the yard waste is containerized or is placed in accordance with §
499-3, in the street. If yard waste that is not containerized is placed in the street, the party responsible for placement of yard waste must remove the yard waste from the street or said party shall be deemed in violation of this chapter.
The provisions of this chapter shall be enforced by the Hawthorne
Police Department or the Property Maintenance Officer.

Any person(s) who is found to be in violation of the provisions
of this chapter shall be subject to a fine not to exceed $2,000. Notwithstanding
the same, in the event a summons is issued to a property owner, as
opposed to a landscaper, contractor or other person performing services
as set forth herein, for a first offense hereunder, the fine shall
be $100 and payable upon the issuance of a summons as authorized hereunder.
