The Town of Salina, as a suburban town, hereby
enacts this chapter to create a Department of Planning and Development
to provide for the appointment of a Commissioner of Planning and Development
and to define the duties of the Commissioner and the Department.

Nothing herein shall require any person appointed
as Commissioner of Planning and Development to be a resident of the
Town of Salina.
The Commissioner of Planning and Development
shall report to the Town Supervisor as chief executive officer of
the Town pursuant to the Suburban Town Law and shall have the following duties and responsibilities:
A. Coordination and staff support to the Zoning Board,
the Planning Board, the Town Board, the Assessor's office, the Highway
Department and other boards or agencies involved in land use, planning
or development within the Town of Salina.
B. Review of plans and applications for compliance with
New York State and local statutes, codes, rules and regulations, including
the State Uniform Fire Prevention and Building Code and the State Energy Code.
C. Provide necessary coordination and cooperation with
the Fire Commissioners, Fire Prevention Bureau and Fire Chiefs concerning
issues relating to firesafety and fire prevention.
D. Establish a system for the receipt of and accounting
for all fees received by the Department.
E. Conduct investigations and act on complaints involving
codes, signs and ordinances within the Town of Salina.
F. Make inspections of work in progress and conduct periodic
inspections for continued compliance.
G. Create an integrated file system by which all records
and information related to planning, zoning and inspections for a
parcel are readily available to all boards and the public in general,
including the development of forms, procedures and systems for the
exchange of information between all boards, agencies or employees
of the Town involved in land use, planning and development.
H. Supervise and review the work of Department subordinates
and periodically report to the Supervisor and the Town Board concerning
the operation of the Department.
I. Have and exercise those powers and duties otherwise
granted to the Code Enforcement Officer or the Building Inspector
by state or local law, ordinance or regulation.
J. Establish a procedure for all referrals required by
general state and/or local laws to be made in connection with applications
before the Planning Board or the Zoning Board of Appeals.
K. Be responsible, after consultation with the attorney
for the Planning Board or the Zoning Board of Appeals, for the preparation
and publication of all legal notices in connection with applications
before the Planning Board or the Zoning Board of Appeals.
L. Plan, organize, direct and review administrative procedures
necessary to the operation of the Department of Planning and Development.
M. Appoint and remove employees of the Department in
accordance with applicable civil service rules and regulations and
collective bargaining procedures.

The Commissioner may appoint one or more Code
Enforcement Officers, Deputy Code Enforcement Officers or one or more
Fire Marshals as the need may appear and the positions have been authorized
by the Town Board, to act under the supervision of the Commissioner
and to exercise any portion of his powers and duties. The compensation
of such officers shall be fixed by the Town Board.

The Commissioner may appoint one Deputy Commissioner
of Planning and Development, who shall be an officer of the Town,
to act under the supervision of the Commissioner and to exercise any
portion of his powers and duties. The compensation of such official
shall be fixed by the Town Board. Said Deputy Commissioner of Planning
and Development shall serve at the pleasure of the Commissioner.

A. No person
appointed as a Code Enforcement Officer shall be required to be an
elector or resident of the Town of Salina at the time of appointment
and throughout the term of office, provided such person at the time
of appointment and throughout the term of office is a resident of
the County of Onondaga.
B. This section
is intended to supersede in part the provisions of New York State
Town Law § 223(1) and Public Officers Law § 3(1),
which require an officer to be a resident and an elector of the Town
at time of appointment and during the term of office.
