As used in this chapter, the following terms shall have the
meanings indicated:
The entire width of the highway between the boundary lines
of any way or place (the entire highway right-of-way) of any highway
open to vehicular traffic, and shall include the entire shoulder of
the highway, or other property owned by the Town of Lockport.
It shall be unlawful for any person to operate a snowmobile
on any Town highway in the Town of Lockport, except in emergency situations
as set forth in Parks, Recreation and Historic Preservation Law § 25.05,
Subdivision 2(b), and except for direct crossings at an angle of approximately
90° to the direction of the highway, pursuant to Parks, Recreation
and Historic Preservation Law § 25.05, Subdivision 3, unless
such highway has been designated by resolution of the Town Board of
the Town of Lockport as a highway open for snowmobile use.
No snowmobile shall be operated upon any parkland of the Town
of Lockport or other land owned by the Town of Lockport.
No person shall operate a snowmobile in the Town of Lockport
in violation of Title D of the New York State Parks, Recreation and
Historic Preservation Law.[1]

When snowfall or plowing has established an outside bank outside
the crest furthest removed from the highway, which is beyond the shoulder
of the road, this chapter shall not prevent travel of snowmobiles
upon such outer bank, provided that in no event shall snowmobiles
be operated upon shoulders of highways.
A violation of this chapter shall constitute an offense and
shall be punishable by a fine of not more than $250 or imprisonment
of not more than 15 days, or by both such fine and imprisonment.
This chapter is adopted pursuant to the authority authorized
by Town Law § 64, Subdivision 23, and § 130, Subdivision
7; Vehicle and Traffic Law § 1660, Subdivision 25; Title
D of the Parks, Recreation and the Historic Preservation Law; and
Municipal Home Rule Law § 10, Subdivisions 1(ii)a(1) and
1(ii)d(3), and shall supersede any conflicting state law.
