A. Every applicant for development, site plan review
(or waiver), rezoning or variance shall pay application fees and escrows
to the City of Somers Point in accordance with the following schedule:

[1] If City maps and records require revisions as a result of an approved
minor subdivision, the applicant shall pay a fee of $100 upon approval.

approval.

(b) Fees for map amendments. If City maps and records require revisions
as a result of an approved site plan, the applicant shall pay a fee
of $50 upon approval.

Revised plan submissions: Where development
plans are classified incomplete for any reason, the applicant, when
resubmitting the plan, shall pay an additional 1/2 of the original
application fee and escrow charged. This fee shall be paid upon each
resubmission. Such fee shall not apply when revised plans are submitted
to satisfy a condition of approval required by Board action on the
application.
(4)
Variances.
(a)
N.J.S.A. 40:55D-70a and 70b: an application
fee for $150 with no escrow.
(b)
N.J.S.A. 40:55D-70c: an application fee of $200
for residential and $750 for commercial with no escrow, except when
the application is made for an accessory building of less that 150
square feet, or a fence costing not more than $1,500, the fee shall
be $50 with no escrow, provided that such application is scheduled
for a meeting with at least one other application. If a single application
for a shed or a fence variance is to be the only scheduled case to
be heard by the Zoning Board, then an application fee of $200 with
no escrow is required.
(c)
N.J.S.A. 40:55D-70d: An application fee of $750
with escrow as determined by the Planning and Zoning Administrative
Officer.
(d)
If the application requires more than one type [Subsections
A(4)(a) through
A(4)(c)] of variance, the applicant shall pay the fee required for each type requested.
(e)
For fee and escrow purposes, all variances requested in Subsection
A(4)(c) shall be considered one variance request.
(5)

or subdivision approvals shall have an application fee 50% of the
original fee, and an escrow fee 50% of the original amount.

Rezoning. Requests for rezoning shall have an
application fee of $200 and an escrow fee of $8,000.

Exemption from the payment of any fee charged
in connection with any application for development which promotes
accessibility by disabled persons to their own living unit. In accordance
with N.J.S.A. 40:55D-8e, a disabled person, or a parent or sibling
of a disabled person, shall be exempt from the payment of any fees
charged in connection with any application for development which promotes
accessibility to his own living unit.
B. All applications shall be deemed incomplete until
the applicable application fee(s) and escrow funds have been paid
in full to the Planning and Zoning Administrative Officer. The application
charge for requests for rezoning, subdivisions and site plans is a
flat fee to cover administrative expenses. The escrow amount is established
to cover the costs of professional services, including engineering,
legal and other expenses connected with the review of the submitted
materials. Where the applicant requests a rezoning, the costs shall
also include the professional fees incurred in drafting or reviewing
the ordinance and the expense of providing public notice. Sums not
utilized in the review process shall be returned to the applicant.
The escrow account schedule is only an estimate based on average costs.
If additional sums are deemed necessary, the applicant shall be notified
of the required additional amount and shall add such sum to the escrow.
Final approval is contingent upon receiving additional sums where
applicable. The Planning and Zoning Administrative Officer shall exercise
his/her discretion in establishing the amount required for the escrow
account if the project is of a nature not expressly included in one
of the aforementioned categories. In the event that the escrow account
is insufficient to cover the cost of professional service, including
legal, engineering and other expenses connected with the review and
approval of the application, the applicant shall still be required
to pay such fees which shall first be reviewed and approved by the
Planning and Zoning Administrative Officer. It is the intent of this
provision that all fees, costs and expenses incurred by the City,
the Planning Board or Zoning Board of Adjustment shall be passed through
to and paid by the applicant.

C. Where one application for development includes several
approval requests, the total sum of all of the individual required
fees and escrows shall be paid.
D. Each applicant with an application for development
including but not limited to preliminary or final subdivision or site
plan approval (or waiver) shall agree, in writing, to pay all reasonable
costs for professional review of the application and for inspection
of the improvements required by the Board. Such costs must be paid
in full before any approval shall take effect or construction permits
are issued.
E. Application fees and escrow funds must be submitted
in separate checks payable to the City of Somers Point and submitted
to the Planning and Zoning Administrative Officer. The City Treasurer
shall deposit the escrow funds into a developer's escrow account and
the application fees into the City's general account.
F. The applicant shall pay all professional fees and
costs incurred as a result of a special Board Meeting held at the
applicant's request or with the applicant's approval.
