This article shall be known as "The Atlantic County Division
of Public Health Fee Ordinance."
Incorporated into this article are the word and phrase definitions
contained in the Definition Tables of the New Jersey Administrative
Code (N.J.A.C.) Title 7, Department of Environmental Protection, and
Title 8, Department of Health and Senior Services, as if specifically
set forth herein. In addition to the definitions contained in the
New Jersey Administrative Code, Title 7 and Title 8, the following
additional definitions are adopted as part of this article:
BODY ART
Tattoos, piercings and permanent cosmetics done to the body.
REINSPECTION
An inspection of an individual subsurface sewage disposal
system that did not meet applicable standards during a previous inspection.
SEPTIC PLAN
Application for an individual subsurface sewage disposal
system.
SEPTIC REPAIR
An application to repair an individual sewage disposal system
as outlined in N.J.A.C. 7:9A-1 et seq.
WATER SUPPLY CERTIFICATION
A certification that a proposed water supply is in compliance
with the provisions of the Realty Improvement Sewerage and Facilities
Act (N.J.S.A. 58:11-23 et seq.) and the standards for construction
of such water supply (Well Construction and Maintenance), N.J.A.C.
7:9D-1 et seq.; New Jersey Safe Drinking Water Act, N.J.A.C. 7:10-1
et seq.).
WELL
Any hole or excavation constructed for the purpose of removal
of water as defined in Well Construction and Maintenance (N.J.A.C.
7:9D-1 et seq.).

All required fees established by this article shall be paid upon submission of applications or other associated documentation for a permit, approval or certification or within 15 days of receipt of a statement for other program services outlined in §
73-14 from the Atlantic County Health Department.
In addition to any other liability or penalty imposed by law,
any person violating any provision of this article:
A. Shall be subject to a penalty of not less than $100 nor more than
$500 for each offense;
B. Each and every day in which a violation of any of the provisions
of this article exists shall constitute a separate offense.
Pursuant to N.J.S.A. 26:3A2-27, this article supersedes all
inconsistent municipal and Local Board of Health Ordinances regulating
the same subject matter.
Pursuant to N.J.S.A. 26:1A-12a, a certified copy of this article
shall be submitted to the New Jersey Commissioner of Public Health,
immediately upon passage of the same.
