This Part shall be known as the "Cross Keys Water Service District
Ordinance."

The purpose of this Part is to ensure safe potable drinking
water for the citizens, residents and business, including business
invitees, located within the Cross Keys Area. Plumstead Township,
in conjunction with neighboring Buckingham Township and Doylestown
Township and the Pennsylvania Department of Environmental Protection
("PADEP"), seeks to mitigate groundwater contamination in the Cross
Keys Area. PADEP has identified existing groundwater contamination
in the Cross Keys Area involving contaminates Tetrachloroethene ("TEC")
1,1-Dichloroethene ("1,1-DCE") and 1,4-Dioxane; contaminates which
can enter the human body via absorption, ingestion and inhalation.
Doylestown Township has agreed to serve as the lead agency in a joint
effort with PADEP, Buckingham Township and Plumstead Township to construct
a public water system in the Cross Keys Area to facilitate the supply
of safe potable water to certain landowners, their guests and invitees.
Plumstead Township, in support of this mitigation project and to protect
the public health and safety of its citizens and visitors, hereby
adopts this Part pursuant to 53 P.S. § 67603 (Connection
to Water System) of the Second Class Township Code, as amended.

Property owners located in the Cross Keys Water Service District,
as defined below, shall connect with and use the public water system
of the Doylestown Township Municipal Authority.

The Cross Keys Water Service District shall include an area
of the Township having been identified as having contaminated groundwater.
The Cross Keys Water Service District shall be in the area shown and
bounded as set forth in the map attached hereto and made a part hereof
as Appendix "A." Doylestown Township Municipal Authority shall not extend
its supply of public water in Plumstead Township beyond the Cross
Keys Water Service District as shown on Appendix "A."

Within the Cross Keys Water Service District, Doylestown Township
Municipal Authority shall be the sole and exclusive provider of public
water.

If any landowner required to connect with and use the water
system fails to do so within 90 days after notice to do so has been
served by the Board of Supervisors or the Doylestown Township Municipal
Authority, the Board of Supervisors or the Doylestown Township Municipal
Authority may enter the property and construct the water connection.
If Plumstead Township or Doylestown Township Municipal Authority constructs
the water connection, the landowner shall immediately reimburse Plumstead
Township or Doylestown Township Municipal Authority the costs incurred
in constructing the connection. Should the landowner fail or refuse
to pay the costs to construct the water connection, Plumstead Township
and Doylestown Township Municipal Authority shall enforce the claim
as a municipal claim pursuant to 53 P.S. § 7101 et seq.

Any landowner who shall violate a mandatory water connection
pursuant to this Part shall, upon conviction in a summary proceeding
brought before a Magisterial District Judge under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense and shall
be punishable by a fine of not more than $1,000, plus costs of prosecution.
In default of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this Part that is violated
shall also constitute a separate offense.

The Pennsylvania Department of Environmental Protection shall
be notified, in writing, of any amendment made to this Part.
