GENERAL REFERENCES

It is hereby declared that any and all assemblies of 200 or more people on private property or properties in the Town of Saugerties without first obtaining the necessary permits required under this chapter are unlawful.
Whenever assemblies or gatherings of 200 or more people are held on private property or properties in the Town of Saugerties, the owner or lessee of the property and the sponsor, sponsors or person in charge of the assembly or gathering shall, jointly, prior to holding such assembly or gathering, obtain a permit from the Ulster County Department of Health certifying that the sanitation facilities to be provided for such assembly or gathering are adequate to accommodate the needs of the persons to be assembled and shall also obtain a permit from the Town Board of the Town of Saugerties, New York, authorizing the holding of such assembly or gathering.
The application for the permit from the Ulster County Department of Health shall be made at least 30 days prior to the date of the assembly or gathering and shall state:
A. 
The date and the hours during which such assembly or gathering will be held.
B. 
The number of people expected to attend the assembly or gathering.
C. 
The number, type and location of toilet facilities.
D. 
The source of water and the supply thereof which will be used on the premises to adequately accommodate the persons assembled for all purposes.

The application for the permit from the Town Board shall be made at least 90 days prior to the date of the assembly or gathering. The fee for such permit shall be established from time to time by resolution of the Town Board and shall be submitted with the application. Application for a permit shall be by verified petition addressed to the Town Board and signed by the applicant and the landowner and shall include the following information and material:
A. 
A statement of the name, age and residence address of the applicant; if the applicant is a corporation, the names and addresses of directors, officers and stockholders owning 5% or more of the number of shares outstanding of each class of stock; if the applicant is a partnership or other organized group of individuals, the names, addresses and ages of each and every individual associated with the partnership or other entity.
B. 
A statement containing the name and address of the owner of the property upon which the event is to occur and the nature and interest of the applicant therein; the proposed dates and hours of such event; a detailed description of the event; the expected maximum number of persons intended to use the property at one time and collectively; the expected number of automobiles and other vehicles intended to use the property at one time and collectively; the purpose of the function, including the nature of the activities to be carried on and the admission fee to be charged, if any; the names and addresses of all concessionaires and other persons providing any services or facilities under contract, lease or other arrangement for the event; and whether any alcoholic beverages will be sold, provided or allowed at the event.
C. 
The date and hours during which such assembly or gathering will be held.
D. 
An adequate map showing the size of the property; the names of the record owners of the adjoining properties; the streets or highways abutting said property; the size and location of any existing building, buildings or other structures or facilities to be erected thereon for the purpose of the assembly; the placement of the proposed distribution system of water; the location of any parking areas for automobiles and other vehicles and the means of ingress and egress to such parking areas; all service and other roads; the camping area, food services, toilet facilities, garbage and refuse collection facilities and entertainment and performance areas, if applicable.
E. 
A detailed plan and statement with drawings showing the layout of any parking area for automobiles and other vehicles and the methods of traffic control to be used thereon. Such parking area shall provide parking space of acceptable size for one motor vehicle for every four persons in attendance.
F. 
A detailed plan and statement with drawings showing the facilities for the preparation, storage and distribution of food and the means of servicing such area. Such plan such also detail the method and means of disposing of any garbage, trash, rubbish and other refuse.
G. 
A detailed plan and statement fully describing any private security personnel who will be engaged by the applicant to serve on or about the site during the event and the qualifications and source of such personnel.
H. 
A detailed plan and statement providing for fire protection, specifying the location of fire lanes, water supply and equipment or apparatus to be available for such purposes.
I. 
A detailed plan and statement specifying the facilities to be available for medical, surgical, nursing and ambulance service.
J. 
A detailed description of all insurance policies and surety bonds to be provided by the applicant for the protection of the general public, the Town of Saugerties and its various public bodies, officers and employees. Certificates of such insurance and bonds shall be submitted to the Saugerties Town Board at least 15 days prior to the commencement date of the event.
K. 
A subscribed authorization from the landowner and the applicant to the Town of Saugerties and the County of Ulster to permit the Town and County and their legal agents to go upon the property for the purpose of inspecting the same to determine if there is compliance with the requirements of this chapter and the permit, if granted; that adequate police and fire protection have been provided; and that persons and property have been protected from danger.
L. 
The number of tickets to the assembly or gathering which will be available for sale or distribution and a statement subscribed by the applicant that the applicant will specify in all advertising and promotional endeavors the limitation on the number of tickets to be sold or otherwise issued as specified in the permit.

A. 
No permit shall be issued unless the applicant shall furnish to the Town of Saugerties a comprehensive liability insurance policy insuring the Town against liability for damage to persons or property, with limits of not less than $500,000/$1,000.000 for bodily injury or death and limits of not less than $500,000 for property damage, sufficient in form to insure, indemnify and save the Town harmless from any liability or causes of action which might arise by reason of granting of the permit, and noncancellable without 10 days' prior written notice to the Town
B. 
No permit shall be issued unless the applicant shall deposit with the Clerk of the Town of Saugerties cash or good surety company bond in such sum, not less than $100,000, as the Town Board may reasonably require and conditioned that all requirements of the permit will be fully performed by the applicant; that no damage will be done to any public or private property; and that the applicant will not permit any litter, debris or other refuse to remain upon any public or private property by reason of the granting of the permit, which cash shall be refunded or surety company bond canceled upon certification by the Saugerties Town Board that all conditions of this chapter have been complied with. Such surety bond or cash shall serve as an indemnity to save and protect the streets, pavements, bridges, road signs and other property of the Town of Saugerties and the County of Ulster and any other town and village within the County from any and all damage that may be caused by vehicles, employees or participants in such event, and to be used, if necessary, to restore the ground where such event is held to a sanitary condition and pay all charges and losses to the Town of Saugerties and the County of Ulster and its respective towns and villages for damages to streets, pavements, bridges and other property.

The Town Board shall not issue a permit for the holding of an assembly or gathering of 200 persons or more, unless:
A. 
During the period that the application is pending before the Town Board, it has received a copy of the permit issued by the Ulster County Department of Health certifying that the sanitation facilities are adequate for the size of the assembly or gathering.
B. 
It is satisfied that there will be sufficient personnel on hand to supervise and control the persons in attendance at the assembly or gathering so as not to interfere with the health, welfare, property and repose of persons nearby not in attendance.
C. 
It is satisfied that there will be sufficient parking facilities available to accommodate the motor vehicles of the persons expected to attend the assembly or gathering so as not to interfere with traffic on public highways nearby and to assure the safety of pedestrians thereon.
D. 
It is satisfied that the assembly or gathering would not constitute a public or private nuisance.
E. 
The applicant has obtained a permit issued by the New York State Liquor Authority for the sale of alcoholic beverages, if applicable.
F. 
The application has been referred by the Town Board to the Chief of Police, the Building Inspector/Code Enforcement Officer, the Town Highway Superintendent and the Chief of the Fire District in which the proposed open assembly is to be held for their recommendations at least 30 days prior to action being taken on the application by the Town Board.
G. 
If applicable, the applicant has obtained a mass gathering permit (for gatherings of 5,000 persons or more) pursuant to Public Health Law § 225.
Each such permit when issued shall be valid only for the date and hours specified in the application thereon. Should the applicant desire permits for assemblies or gatherings for two or more different dates, separate applications must be filed for each such dates when such assemblies or gatherings are intended to be held.
If at any time subsequent to the issuance of a permit by the Town of Saugerties, New York, it is found that a material false statement has been made on such application or that more people attend such assembly or gathering than anticipated or indicated, the Town Board of the Town of Saugerties, New York, may revoke such permit.
This chapter shall not apply to assemblies, meetings, dinners or other gatherings held indoors at facilities designed for and regularly operated for such purposes.
A. 
Offense. Any person, including the owner or lessee of the land on which such an assembly or gathering is held, the sponsor and/or person in charge thereof, who violates any provision of the chapter shall be deemed to have committed an offense against this chapter and also shall be liable for said violation.
B. 
Penalties. For every violation of any provision of this chapter, the person violating the same shall be subject to a fine of not more than $250 or imprisonment not exceeding 15 days, or by both such fine and imprisonment.[1]

C. 
Cancellation of assembly. In addition to the above-provided punishment, the Town Board may, if any such assembly or gathering is held without the required permits, direct that such assembly or gathering be cancelled or dispersed.
D. 
Injunctive relief. In addition to the above-provided punishment and penalties, the Town Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance or to restrain by injunction the violation of this chapter.
