There is hereby created a recreation commission known as "the Recreation Commission of Spring Garden Township."
The Recreation Commission of Spring Garden Township shall be composed of seven members, five members to be appointed by the Board of Commissioners, consisting of one resident of each of the five wards; one member of the Board of Commissioners who will be a nonvoting member, to be appointed by the Board of Commissioners each year for a one-year term; and one member a resident of Spring Garden Township, to be appointed by the York Suburban School Board, appointment and term to be determined by the School Board. The Commission members representing each ward, appointed by the Board of Commissioners, shall serve for terms of five years and until their successors are appointed, except that the members first appointed shall be so appointed that the term of one member shall expire annually thereafter. The Board of Commissioners shall be notified of any vacancies, and such vacancy shall be filled in the same manner as the original appointments and for the unexpired term. Members shall serve without pay.

The Recreation Commission shall appoint from its membership a Chairman and such other officers as it may deem necessary for the orderly procedure of its business and may adopt bylaws, rules and regulations covering its procedure not inconsistent with the provisions of the state laws. The Commission shall from time to time make rules governing the operation and conduct of the recreational facilities operated by the Commission. The Commission shall hold regular meetings at such times as it may designate. All regular meetings of the Recreation Commission shall be held in the Township Municipal Building, 340 Tri Hill Road, York, Pennsylvania.
The Recreation Commission shall maintain, operate and supervise the public parks, play fields, and all outdoor and indoor recreation areas and facilities owned and controlled by the Township of Spring Garden.
The Recreation Commission may accept any grant, gift, bequest or donation of services, equipment, real estate, or money from any individual or group, to be used as specified by the donor or by the terms of acceptance. The Recreation Commission shall have no authority to enter into any contract or incur any obligation binding upon Spring Garden Township, other than current obligations or contracts to be fully executed within the then current fiscal year, and all within the budget appropriations made by the Board of Township Commissioners.

The Board of Commissioners shall have the power to appoint a Director of Recreation and shall prescribe the duties of said Director.
Funds appropriated by the Board of Township Commissioners and budgeted for recreation shall be disbursed in accordance with 53 P.S. § 55804 of the Township Code and shall be subject to rules and regulations in effect for all Township expenditures. Funds received by the Recreation Commission from sources other than budget appropriations shall be accounted for and forwarded to the administration office for deposit in the general fund by the Township Treasurer.

The Recreation Commission shall make full and complete reports to the Board of Commissioners at such times as may be designated or requested. The Recreation Commission shall submit a requested budget for the ensuing fiscal year to the Township Manager on or before October 1 of each year. Employees of the Recreation Commission shall be considered as Township employees. The employment of all personnel of the Recreation Commission shall be by the Township Manager after screening by and recommendation of the Recreation Director and Commission and subject to the approval of the Township Board of Commissioners. Wages and salaries of all personnel will be determined by the Board of Commissioners. The fiscal year of said Recreation Commission shall conform to that of Spring Garden Township.
Such powers as are now or may hereafter be provided by statute of the Commonwealth of Pennsylvania, or by ordinances of Spring Garden Township relating to the development and operation of recreation systems, public parks, and playgrounds, are hereby vested in the Recreation Commission, to be exercised by it, subject to any and all restrictions contained in such powers and ordinances.
