The owner of any property zoned residential or A-O, or the lessee of any such property, shall not conduct any so-called garage sale, yard sale or sale of any other personal property without first obtaining a permit from the office of the Township Clerk.
No such sale shall be conducted before 8:00 a.m. in the morning nor after 9:00 p.m. at night. No merchandise intended to be sold shall be displayed on the premises except for one hour before and during said hours of sale. All displayed items shall be removed from the premises or moved indoors before 11:00 p.m. on the day of sale. Nothing shall be displayed on the sidewalk or roadway but kept within the property lines.

No such sales shall be conducted on more than two occasions within any one calendar year and a permit shall be required for each sale. Each sale can be no longer than three consecutive days and the two sales must be separated by at least 24 hours.
No personal property of any kind shall be offered for sale of other than that which has been owned by the applicant and members of his or her immediate family for a period of at least six months prior to said sale.

No loudspeakers, music or undue noise shall be permitted on the premises during the period of the sale, and the seller shall comply with all state laws and health regulations relating to the sale of household furniture. Signs advertising said sale shall have the address of the location of the sale and may be displayed at locations beyond the place of sale if the applicant has the owners' permission to place signs at other locations in the Township, and provided that any sign advertising the sale shall be removed no later than one day following the sale. Signs are not permitted on any utility or traffic control sign poles or posts. Any signs utilized hereunder shall not be displayed more than five days prior to the said sale and shall not exceed two square feet in size.

A fee as established from time to time by resolution shall be charged and collected by the Township Secretary or his agent for the permit, which shall be prominently displayed on the premises on the day of the sale.

Anyone violating the provisions of this chapter shall, after a hearing before a Magisterial District Judge, be subject to a fine of not less than $25 nor more than $600 and, in default of said payment, be sentenced to a term of imprisonment of a term not to exceed 30 days.

All persons charged with a first violation of this chapter may, within three days after receipt of written notice of the alleged violation, voluntarily pay the minimum fine prescribed to the police officer on duty at the Township Municipal Building, but upon failure of said person to pay such fine or if said person again violates any provisions of this chapter, he shall be charged in the manner prescribed by the First Class Township Code.
