It shall be and hereby is declared unlawful
for any person owning, possessing, harboring or having control of
any dog to allow said dog, whether or not tagged or licensed, to be
off said person's premises unless such dog be restrained by a leash
and under the immediate and full control of the owner or person in
charge thereof.
The Dog Warden, or any Assistant Dog Wardens,
or any peace officer, shall seize any dog not so restrained by a leash
and under the immediate and full control of the owner or person in
charge thereof and found off the owner's premises as required herein.
The Village Board may from time to time, by
resolution, adopt rules and regulations hereunder.
No person who owns, possesses or harbors a dog or any other animal (male or female) shall permit or allow it to disturb the comfort, peace or repose of any person in the Village or the community by frequent or long-continued noise. If a complaint is made to the Nassau County Police Department that any such noise has occurred, the owner, possessor or keeper of the offending animal shall be notified of the complaint and of the provisions of this section. If after such notification the violation continues or recurs, then the owner, possessor or keeper shall be subject to the penalties prescribed in §
38-6 hereof.

A. It shall be unlawful for a dog to defecate on public or private property, except in accordance with the requirements of Subsection
B, or on private property, without the consent of the owner or person in possession of such private property. A person owning or possessing a dog which defecates as prohibited herein, with or without the knowledge, consent or fault of such person, shall be guilty of a violation of this section. It shall be presumed that a dog defecating on private property of a person other than the dog’s owner or possessor does so without the consent of the owner or person in possession of such private property.
B. The owner
or possessor of any dog shall immediately remove all feces deposited
by said dog by placing such feces in a plastic bag which shall be
sealed and deposited in a covered garbage receptacle.
An offense against any of the provisions of
this chapter shall be prosecuted either:
A. As a violation pursuant to the Penal Law of the State
of New York, punishable by a fine of not more than $250, and such
violation shall also be punishable by imprisonment for not more than
15 days, or by both such fine and imprisonment; or
B. In an action to recover a civil penalty of not more
than $250.
