The Town Board of the Town of Hartland has previously created the Town of Hartland Planning Board pursuant to § 271 of the Town Law.[1] The Planning Board consists of five members, appointed by the Town Board to serve for terms of five years. No person who holds any elected office in the Town of Hartland shall be eligible for membership on the Planning Board. If a vacancy shall occur in the composition of the Planning Board, it shall be filled by the Town Board by appointment for the unexpired term. The Chairman of the Planning Board shall be appointed by the Town Board.

Planning Board members shall be compensated in such manner as the Town Board shall, from time to time, determine by resolution.

The Planning Board shall have the power to approve:
A. 
Subdivisions, pursuant to Town Law § 276 et seq.
B. 
Cluster development, pursuant to Town Law § 278.
C. 
Special use permits, pursuant to this Code and Town Law § 274-b.
D. 
Site plans, pursuant to this Code and Town Law § 274-a.
E. 
Such other matters as may be referred to it from time to time by the Town Board.
