The premises located in the Village of Quogue, bounded on the north by Dune Road, east by land of Jacobs, south by the Atlantic Ocean and west by land of Peltz, hereinafter referred to as "Quogue Village Beach," is hereby designated a neighborhood recreation center of the Village of Quogue, New York.

A. 
No person arriving on foot or on a bicycle shall enter upon or use the facilities of the Quogue Village Beach unless he is a resident of said Village, as that term is hereinafter defined, and unless he has in his possession a personal permit obtained as hereinafter provided. A valid personal permit holder for bicycle or walking may be accompanied by up to four guests.
B. 
The provisions of Subsection A above shall be in effect during the period in each year from May 15 through September 15.

A. 
No motor vehicle or motorcycle shall be parked upon any part of the Quogue Village Beach unless said motor vehicle or motorcycle is, at the time, owned by and registered in the name of a resident of the Incorporated Village of Quogue, New York, as that term is hereinafter defined, and unless there is, at the time, displayed as directed a parking permit obtained as hereinafter provided.
B. 
The provisions of Subsection A above shall be in effect during the period in each year from May 15 through September 15.

No person shall throw, break, cast, lay or deposit bottles, papers, wrappers, garbage or refuse of any kind or nature upon any part or portion of the Quogue Village Beach, but he shall place the same in the containers provided therefor.

No dogs or other domestic animals shall be allowed upon any part of the Quogue Village Beach from May 15 through September 15 in each year.

No person shall in any manner damage, deface, injure or destroy any structure, planting, roadway, embankment, building or equipment located on the grounds of the Quogue Village Beach.
The selling, vending or offering for sale of any wares, foodstuffs, beverages or other merchandise upon the grounds or in and about the facilities of the Quogue Village Beach is prohibited, unless the Board of Trustees of the Village of Quogue has issued a permit therefor.
Any person using the Quogue Village Beach or any of its facilities shall do so with the understanding that the Village of Quogue assumes no responsibility for any injury or damage which such person may sustain while using said facilities and that said Village will not be responsible for the loss of any personal property on said Quogue Village Beach.

A. 
The Village Clerk and other persons designated by the Board of Trustees are hereby authorized to issue personal permits and parking permits as provided in this article, upon due application and payment of the fee as established by the Board of Trustees.
B. 
The Board of Trustees may fix and establish the fees from time to time by resolution. The Board of Trustees may fix and establish fees in different amounts, based upon the type of permit and the type of resident.
C. 
In the case of seasonal rentals subject to the provisions of Chapter 149, no permit shall be issued to a tenant of such dwelling unless a seasonal rental license has been issued for such dwelling pursuant to Chapter 149. Any permit issued hereunder shall only be issued to persons listed as a tenant in the application for such seasonal rental license.
D. 
The Board of Trustees may adopt and establish regulations applicable to issuance of permits under this article from time to time by resolution. Without limiting the foregoing authorization, such regulations may provide for issuance of temporary permits under special circumstances, such as issuance of a temporary permit to a bona fide guest of an owner of a dwelling within said Village where such guest is occupying such dwelling in such owner's absence.

As used in this article, the following terms shall have the meanings indicated:
HOUSEHOLD MEMBER
Includes spouse, parents and children of the person involved who live in the same dwelling as such person and any live-in help.

RESIDENT
Any one of the following:
A. 
A person who owns real property within the Village of Quogue and the household members of such person.
B. 
A person who is qualified to vote at a Village election in said Village and the household members of such person.
C. 
A member in good standing of the Quogue Fire Department and the household members of such member.
D. 
A member in good standing of the Westhampton Ambulance Corps and the household members of such member.
E. 
A person who is in the employ of said Village and the household members of such person.
F. 
A person who is a tenant or household members of tenant of any dwelling or apartment within said Village for any portion of the summer season (the period from May 15 through September 15).

G. 
In the case of property that is owned by a corporation, limited liability company, trust or other entity, a person who holds an equity interest in such entity and is an actual occupant of such property shall be a resident.

All permits shall expire on June 1 in the year succeeding the year in which issued, unless revoked as hereinafter provided.
Any permit issued hereunder or privilege conferred hereby may be revoked by the Board of Trustees for abuse of the privileges conferred hereby or violation of any of the provisions hereof.

The Board of Trustees may adopt and establish regulations with respect to the hours of operation of the Quogue Village Beach from time to time by resolution.

A. 
Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $1,000 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. In addition to such penalty, the owner or operator of any automobile or motorcycle parked without valid permit upon said Quogue Village Beach shall be subject to having said automobile towed away at the owner's expense.
B. 
For each and every violation of this article, the person or persons responsible for, causing, permitting, assisting in or refusing to abate or correct such violation shall be subject to a civil penalty not exceeding $1,000 for each and every such violation. The continuation of a violation of this article shall constitute, for each day the violation is continued, a separate and distinct violation hereunder.
