The Town of Bolton will accept from any person any sum of money not less than $100, the interest whereof shall be applied to the care and repair of such lot or lots in the public burial ground of the Town as the person depositing the money shall designate, in accordance with MGL c. 114, § 25.
A. 
All such money shall be deposited by the Town Treasurer to the credit of the burial fund. The Treasurer shall keep the account of the burial lot fund in a book showing the date of each deposit, the amount deposited, the name of the depositor, the name of the cemetery containing the lot and the number of the lot.
B. 
The Treasurer shall give the depositor a receipt in the following form:

This certifies that ____________________ has deposited with me the sum of ____________ Dollars, the interest of which is to be forever applied in accordance with the provisions of Section 25, Chapter 114, Massachusetts General Laws, for the care of lot number __________ on the plan of the ____________________ Cemetery.

C. 
The Cemetery Committee shall not be required to expend the interest on each deposit annually but may, at its discretion, allow it to accumulate in order to do more satisfactory work.
A. 
Fees for graves in any cemetery shall be established by the Cemetery Committee. One hundred percent of this fee shall be deposited in the burial fund (also known as the perpetual care fund), and the interest from this fund shall be used to maintain the cemeteries in accordance with Massachusetts General Laws and the Code of the Town of Bolton.

B. 
The assignment of lots shall convey only the right of burial. The title to all lots shall be vested in the Town.
C. 
No lots shall be graded, nor shrubbery or trees planted, nor monuments erected, in any cemetery, except with the approval of the Cemetery Committee.

A. 
Any grave opened in Bolton cemeteries shall be paid for at the rates set by the Cemetery Committee. Rates may differ between regular hours, overtime, weekends and holidays.
B. 
Winter burial shall be at the discretion of the Cemetery Committee and if done with extra equipment (i.e., compressor, plowing, sanding) shall be paid for by the deceased's account.
C. 
This money shall revert to the Town treasury and shall be used in accordance with MGL c. 114, §§ 15 and 25.

Within 30 days after the closing of a grave, a flush marker shall be placed on such grave under the direction of the Cemetery Committee.

A. 
There shall be a Cemetery Committee composed of three members elected by the Town, each serving a term of three years so that the term of office of at least one member expires each year.
B. 
The duties of the Cemetery Committee shall include, but not be limited to, establishing rules and regulations for the Town's cemeteries and use thereof, upholding the Code of the Town of Bolton, and upholding other applicable laws.
