Wherever a space shall be marked off on any highway for the
parking of an individual vehicle, every vehicle there parked shall
be parked within the lines bounding such space.
No person shall park a vehicle upon any of the highways or parts
thereof described below except at the angle designated and only within
the painted stall lines. On all highways or portions thereof where
angle parking is now or shall hereafter be authorized, all vehicles
parked thereon shall be parked with the front thereof nearest the
curb.

the hours specified, for longer than the time limit indicated below,
provided that if parking meters have been installed at any of the
described locations, the parking time limits for parking meters shall
be observed:

Except for a vehicle(s) for which the restriction was created,
no person shall park a vehicle at any location where an act of Borough
Council has created a special purpose parking zone where normal parking
is restricted during certain hours of the day, weeks of the month,
or months of the year, or for specific purpose or by type of vehicle,
and where such zone is marked by official signs and roadway markings
in compliance with prevailing PennDOT requirements.

A. No recreational equipment as defined in Subsection
D hereof shall be parked or stored on any street, alley or thoroughfare within the Borough of Mahanoy City; provided however, that such recreational equipment may be parked on any such street, alley or thoroughfare for a period not to exceed seven days or 168 hours during loading or unloading. While so temporarily parked, any such recreational equipment which is not self-propelled must be attached to a motorized vehicle displaying current license plates and registration and be fully insured as required by law.
B. No utility trailers shall be parked or stored on any street, alley
or thoroughfare within the Borough of Mahanoy City, whether or not
it is attached to a motorized vehicle; provided, however, that utility
trailers may be parked on any such street, alley or thoroughfare for
a period not to exceed 48 hours during loading and unloading. While
so temporarily parked, any such utility trailer must be attached to
a motorized vehicle displaying current license plates and registration
and be fully insured as required by law.
C. No recreational equipment shall be used for living, sleeping or housekeeping
purposes when parked in any location not approved for such use.
D. "Recreational equipment" is defined as boats, boat trailers, travel
trailers, pickup campers or coaches (designed to be mounted on automotive
vehicles), motorized dwellings, tent trailers, buses and the like,
and cases or boxes used for transporting recreation equipment whether
occupied by such equipment or not.
E. Any person who violates or permits a violation of this section shall,
upon conviction in a summary proceeding under the Pennsylvania Rules
of Criminal Procedure, be guilty of a summary offense and shall be
punishable by a fine of not more than $1,000, plus court costs and
reasonable attorneys' fees incurred by the Borough in the enforcement
proceedings. Upon judgment against any person by summary conviction,
or by proceedings by summons on default of the payment of the fine
or penalty imposed and the costs, the defendant may be sentenced and
committed to the county correctional facility for a period not exceeding
30 days. Each day that such violation exists shall constitute a separate
offense, and each section of this section that is violated shall also
constitute a separate offense. In addition to or in lieu of enforcement
under this section, the Borough may enforce this chapter in equity
in the Court of Common Pleas of Schuylkill County.

Except for emergency vehicles and highway maintenance vehicles
engaged in official business, no motor vehicle having an unloaded
weight of more than four tons, i. e., 8,000 pounds, nor a trailer
equipped with a refrigeration unit shall park or stand upon any street
or highway within the Borough between the hours of 10:00 p.m. and
6:00 a.m.

A. Except as set forth below, any person violating the provision of
this article shall be guilty of a summary offense and, upon conviction
thereof, shall be punishable by a fine up to $50 and costs of prosecution,
provided that if a notice of violation is placed upon a vehicle, stating
the monetary amount to be paid at the Police Department in satisfaction
of the violation and the time within which such payment is to be made,
the payment of the stated amount at the Police Department of the Borough
of Mahanoy City within the stated time shall be deemed to be in full
satisfaction of the violation.

The Borough of Mahanoy City finds it necessary to regulate the
parking of large vehicles and trailers to reduce public safety hazards
and maintain the quality of residential neighborhoods, thereby preserving
the value of property in those districts. The street grid in Mahanoy
City predates the manufacturing and licensing of certain vehicles
and trailers. These vehicles and trailers create safety hazards by
encroaching into the abutting lane and moving traffic across the center
lane. Such parking and obstructions, besides being a public safety
issue, impedes the free flow of traffic. Parked close to an intersection,
such vehicles and trailers, negatively impact the distance for vehicles
entering the street. Certain vehicles and trailers parked in residential
areas generate complaints from residential neighborhoods in regard
to traffic impediments and safety hazards, as well as noise.

BUS
A motor vehicle designed to transport 16 or more passengers,
including the driver; or a motor vehicle, other than a taxicab or
limousine, designed to transport not more than 15 passengers, including
the driver.
MOTOR HOME
A motor vehicle designed or adapted for use as a mobile dwelling
or office, except a motor vehicle equipped with a truck-camper.
OVERSIZED VEHICLE
A motor vehicle that has a Class 5 license or above, or any
equivalent license or above, or with a gross vehicle weight of over
11,000 pounds and/or exceeds 20 feet in length.
OWNER
A person, other than a lienholder, having the property right
in or title to a motor vehicle. The term includes a person entitled
to the use and possession of a vehicle subject to a security interest
in another person, but excludes a lessee under a lease not intended
as security.
PARK or PARKING
When permitted, means the temporary storing of a vehicle,
whether occupied or not, off the roadway; and, when prohibited, means
the halting of a vehicle, whether occupied or not, except momentarily
for the purpose of and while actually engaged in loading or unloading
property or passengers.
SCHOOL BUS
A motor vehicle which is designed to carry 11 passengers
or more including the driver and is used for the transportation of
preprimary, primary or secondary school students to or from public,
private or parochial schools or events related to such schools or
school-related activities. The term does not include a motor vehicle
used to transport preprimary, primary or secondary school students
to or from public, private or parochial schools or events related
to such schools or school-related activities, which is designed to
carry 11 to 15 passengers, including the driver, and which is registered
in this commonwealth as a bus prior to March 1, 1993; or, a motor
vehicle which is designed to carry 11 to 15 passengers, including
the driver, and which was titled to any public, private or parochial
school on or before March 1, 1993, and which is registered to that
public, private or parochial school in this commonwealth as a bus
prior to September 15, 1993.
STREET
Any thoroughfare, street, ally or court.
TRAILER
Every vehicle, wagon or truck without motor power designed
to carry property or passengers wholly on its own structure and to
be drawn by a motor vehicle.
TRUCK CAMPER
A structure designed, used or maintained primarily to be
loaded or affixed to a motor vehicle to provide a mobile dwelling,
sleeping place, office or commercial space.
TRUCK TRACTOR
A motor vehicle designed and used primarily for drawing other
vehicles and not so constructed as to carry a load other than a part
of the weight of the vehicle and load so drawn.

It shall be unlawful for any person to park, or allow to remain
parked, on any street or parts of streets, the following: buses, motor
homes, oversized vehicles, school buses, tractor trailers, food/vending
trucks, trailers, or truck campers within the Borough limits unless
the owner is granted a Borough trailer parking permit after application
to the Borough office.

The provisions of §
179-27.6 shall not apply to:
Vehicles owned or utilized by the Borough of Mahanoy City; vehicles
engaged in the work of a public utility; vehicles of service companies,
fire trucks and/or Borough-authorized emergency vehicles, contractors,
repairmen, delivery trucks or others actually engaged in working operations
or Borough public events in the vicinity during the actual period
of such between the hours of 7:00 a.m. and 8:00 p.m.

For violations of Chapter
179, Article
III, §
179-27.6, the owner or operator shall be penalized pursuant to Chapter
179, §
179-27.3 of this Code. In addition to penalties as prescribed, the Borough of Mahanoy City may have the vehicle or trailer immediately towed.
