This district is planned to protect and foster business, including
the identification of a central business section to enable purchasers
to shop for a considerable variety of items with a minimum of travel;
to have sufficient, convenient and proper parking facilities to attract
customers; to locate parking on the outskirts of this central business
section so as to avoid congestion in the business section itself;
to provide attractive stores and buildings; to provide loading facilities;
and to promote trade and business.

A. Statutory authority. This amendment to §
66-15 of the Malone Village Code is adopted pursuant to the provisions of §§ 7-706 and 7-708 of the Village Law of the State of New York.
B. Statement of legislative intent. This amendment is intended to restrict
townhouse/apartment uses to the second floor and above in the portion
of the Zoning District B, General Business District, along the north
side of Main Street in the Village of Malone from Brewster Street
to the west side of Morton Street and the south side of Main Street
from Academy Street to Clay Street, also known as the "Downtown Business
District."
C. List of permitted uses in the portion of Zoning District B along
the north side of Main Street in the Village of Malone from Brewster
Street to the west side of Morton Street and the south side of Main
Street from Academy Street to Clay Street. The list of permitted uses
requiring site plan review in the portion of Zoning District B along
the north side of Main Street in the Village of Malone from Brewster
Street to the west side of Morton Street and the south side of Main
Street from Academy Street to Clay Street is hereby amended to be:
(1) Multifamily
dwelling on second floor or above.
(2) Lodging
or boardinghouse or tourist home.
(3) Churches;
religious, school and municipal, public or quasipublic buildings and
institutions.
(4) Hotels,
motels, banks, business or professional offices, studios.
(5) Retail
or wholesale stores, personal service shop, launderette.
(6) Restaurant,
theater, public recreation or entertainment uses.
(7) Business
signs not to exceed 32 square feet.
(8) Accessory
buildings and uses.
(9) Adult
use or entertainment establishments are only permitted with the issuance
of a special use permit.
D. Prohibition. Uses not listed among the permitted uses requiring site
plan review in the portion of the Zoning District B along the north
side of Main Street in the Village of Malone from Brewster Street
to the west side of Morton Street and the south side of Main Street
from Academy Street to Clay Street are prohibited.
