The City Planning Board is hereby authorized to delegate its site review duties authorized under Chapter
63, Planning Board, of this Code and New Hampshire Revised Statutes Annotated 674:43, in regard to minor site plans, to a committee to be known as the "Technical Review Committee," to be composed of technically qualified administrators appointed by the Planning Board. The Technical Review Committee shall include the Planning Director and six other technically qualified administrators from relevant departments, including Public Works, Water Works, Fire, Police, Assessing and Building or Code Enforcement or their respective designees.
The Planning Board shall adopt rules of procedure which shall
govern the conduct of and proceedings of the Technical Review Committee.
The Technical Review Committee shall have authority to accept
or reject applications and to approve or disapprove applications for
minor site plan approval, provided that the decision of the Committee
may be appealed to the full Planning Board, pursuant to Chapter 674:43,
New Hampshire Revised Statutes Annotated, if notice of appeal is filed
within 20 days of the Committee's decision. All provisions of
RSA 676:4 shall apply to actions of the Technical Review Committee,
except that said Committee shall act to approve or disapprove within
60 days after submission of completed applications, subject to extension
or waiver, as provided for in RSA 676:4, I(f). The action of the Technical
Review Committee in approving minor plans and of administrative officials
in issuing permits shall be stayed by any appeal taken and authorized
under this section, pending the final action of the Planning Board
on the appeal in the form of its written notice of action.
The Planning Board shall adopt provisions within Chapter A242,
Site Plan Review, specifying application acceptance and approval procedures
and defining what size and kind of site plans may be reviewed by the
Technical Review Committee. Upon completion of the first six months
of operation, and annually thereafter, the Planning Director shall
prepare, and the Planning Board shall review the work load, performance,
complaints and provisions herein to determine successful achievement
of the goals stated within these regulations and to further determine
any problem areas and necessary corrections.
