For the purpose of establishing minimum standards governing
supplied utilities and facilities and other physical things and conditions
essential to ensure that structures and dwellings are safe, sanitary
and fit for occupation and use, there is hereby adopted by the City
of Laconia the BOCA National Property Maintenance Code/1996.
This chapter and code shall be known and may be cited as the
"Housing Code."
There is hereby created and established an appeals board which
shall be known and may be cited as the "Board of Housing Standards,"
which will consist of five members as follows: the Chief of the Fire
Department and four members of the public appointed by the City Council
for terms of four years, with the terms to end on the fourth Tuesday
of March in each year or until a new appointment is made.
This chapter shall be enforced by the Code Enforcement Director.

The following amendments shall be made to the BOCA National
Property Maintenance Code/1996:
A. Section PM-111.2, Membership of the Board, shall be deleted and replaced by §
155-3 of this chapter.
B. Section PM-111.2.1, Qualification, shall be deleted and replaced by §
155-3 of this chapter.
C. Delete present Section ES-301.6 entitled "Weeds"; amend Section PM-602.2.1
to add date "October 1 to May 15; heat residential."
D. Delete present Section ES-301.7 entitled "Storage area"; amend Section
PM-602.3 to add date of "October 1 to May 15; nonresidential."
E. Amend Section 304.15 to add date "April 1 to November 1; insect screens."
No officer or employee charged with the enforcement of this
chapter and acting for the City of Laconia in the discharge of his
duties shall render himself personally liable for any damage that
may accrue to any person or property as a result of his acts in the
discharge of his duties. Any suit brought against any officer or employee
because of any act performed by him under the provisions of this chapter
shall be defended by the City of Laconia until the final determination
of the proceedings therein.
Any person who violates any of the provisions of this chapter
shall be guilty of a violation punishable by a fine not exceeding
$500 or imprisonment for a period not exceeding 90 days, or both.
Such person shall be deemed to be guilty of a separate offense for
each and every day during any portion of which any violation of this
chapter is committed, continued or permitted by such person and shall
be punishable therefor as provided therein.
