No person or corporation shall lay any cables, pipe or pipes
for drainage, house sewerage, water, gas or any other purpose in any
street, square, lane or alley within the City or dig any ditch therefor
until a location for the same has been obtained from the Director
of Public Works. Such officer shall make a record of every location
made by him, and a map or plan thereof shall be made and filed whenever
the City Manager or the City Council so directs.
The powers and duties of the City Council of the City relative
to the location of the lines of telegraph and other companies in highways
are delegated to the Director of Public Works.
Any person who violates any of the provisions of this article
shall be guilty of a violation punishable by a fine of not more than
$500 or imprisonment for not more than 90 days, or both. Such person,
in addition to the penalty, shall be liable for all the expense of
removing or changing such ditch, drain or pipe and shall be deemed
guilty of a separate offense for each and every day during any portion
of which any such ditch, drain or pipe shall remain unchanged after
notice by the Director of Public Works that the same is not in the
location prescribed therefor.
