§ 59-105 Manufacture, sale and storage prohibited.

It shall be unlawful to manufacture, store or sell fireworks, as defined in § 270.00 of the New York Penal Law, in the City of Yonkers.

§ 59-106 Use of fireworks; permit; fee.

A. It shall be unlawful to use, discharge or cause to be discharged, ignited, fired or otherwise set in action any fireworks in the City of Yonkers unless a permit is issued by the Commissioner pursuant to § 405.00 of the Penal Code of the State of New York.

B. No permit shall be issued pursuant to Subsection A of this section unless the applicant pays the permit fee.

§ 59-107 Disposal of unfired fireworks.

Any fireworks that remain unfired after the display is concluded shall be immediately disposed of in a way safe for the particular type of fireworks remaining.

§ 59-108 Seizure of fireworks.

The Commissioner shall seize, take, remove or cause to be removed, at the expense of the owner, all stocks of fireworks offered or exposed for sale, stored or held in violation of this article.
