As used in this chapter, the following terms shall have the meanings as indicated:
BOOM BOXSelf-contained, portable, hand-held music or sound amplification or reproduction equipment capable of emitting sound that is audible at distances exceeding the permissible limits established within this chapter.

COMMERCIAL AREAA group of commercial facilities and the abutting public rights-of-way and public spaces.
COMMERCIAL FACILITYAny premises, property or facility involving traffic in goods or furnishing of services for sale or profit, including but not limited to:

A. Banking and other financial institutions.
C. Establishments for providing retail services.
D. Establishments for providing wholesale services.
E. Establishments for recreation and entertainment.
I. Establishments providing commercial living accommodations and commercial property used for human habitation, when such is the source of the sound under investigation.
COMMERCIAL SCHOOLAn educational or training establishment operated for a business, including the instruction of language, dance, fine or applied arts, martial arts, business, computers, trades, vocations, or the like.

CONSTRUCTIONAny site preparation, assembly, erection, repair, alteration or similar action, but excluding demolition of buildings or structures.
DECIBELThe practical unit of measurement for sound pressure level. The number of "decibels" of a measured sound is equal to 20 times the logarithm to the base 10 of the ratio of the sound pressure of the measured sound to the sound pressure of a standard sound (20 micropascals); abbreviated "dB."
DEMOLITIONAny dismantling, intentional destruction or removal of buildings or structures.
EMERGENCY WORKAny work or action necessary to deliver essential services, including but not limited to repairing water, gas, electricity, telephone or sewer facilities or public transportation facilities, removing fallen trees on public rights-of-way or abating life-threatening conditions.
INDUSTRIAL FACILITYAny activity and its related premises, property, facilities or equipment involving the fabrication, manufacture or production of durable or nondurable goods.
MOTORIZED EQUIPMENTAny power equipment utilizing an electric or internal combustion engine, for the purposes of this code.

MOTOR VEHICLEAny vehicle that is propelled or drawn on land by an engine or motor.
MUFFLERA sound-dissipative device or system for abating the sound of escaping gasses of an internal combustion engine.
MULTI-USE PROPERTYAny distinct parcel of land that is used for more than one category of activity. Examples include, but are not limited to:

A. A commercial, residential, industrial or public service property having boilers, incinerators, elevators, automatic garage doors, air conditioners, laundry rooms, utility provisions, or health and recreational facilities, or other similar devices or areas, either in the interior or on the exterior of the building, which may be a source of elevated sound levels at another category on the same distinct parcel of land; or
B. A building which is both commercial (usually on the ground floor) and residential property located above, behind, below or adjacent.
MUSIC AMPLIFIED CARSOtherwise known as a "boom car," a personal or commercial vehicle with music amplification or reproduction equipment capable of emitting sound that is audible at distances exceeding the permissible limits established within this chapter.

NOISE CONTROL OFFICERAn officer, building inspector or housing inspector of the City of Yonkers, trained in the measurement of sound or a City of Yonkers police officer. Said official is empowered to issue an appearance ticket for violation of this chapter.

NOISE DISTURBANCEAny sound that:
A. Endangers the safety or health of any person;
B. Disturbs a reasonable person of normal sensitivities; or
C. Endangers personal or real property.
PERSONAny individual, corporation, company, association, society, firm, partnership or joint-stock company.
PUBLIC RIGHT-OF-WAYAny street, avenue, boulevard, road, highway, sidewalk, alley or parking lot used by members of the general public.
PUBLIC SPACEAny real property or structures thereon that are either owned, leased or controlled by a governmental entity or used by members of the general public. "Public space" includes but is not limited to parks, sports fields, lots, etc.
REAL PROPERTY LINEEither the imaginary line, including its vertical extension, that separates one parcel of real property from another or the vertical and horizontal boundaries of a dwelling unit that is one in a multi-dwelling-unit building.
RESIDENTIAL AREAA group of residential properties and the abutting public rights-of-way and public spaces.
RESIDENTIAL PROPERTYProperty used for human habitation, including but not limited to:

A. Private property used for human habitation.
B. Commercial living accommodations and commercial property used for human habitation.
C. Recreational and entertainment property used for human habitation.
D. Community service property used for human habitation.
E. Hospitals, long-term medical or residential care facilities.
SCHOOLAny place of education or instruction, other than a commercial school, college, university, theological seminary, convent, monastery, day-care center, children's day camp and religious retreat.

SOUND LEVELThe sound pressure level measured in decibels with a sound-level meter set for A-weighting; "sound level" is expressed in "dBA."
SOUND-LEVEL METERAn instrument used to measure sound level which conforms to Type 1 or Type 2 standards as specified by ANSI Specification S1.4-1971.
WEEKDAYAny day that is not a legal holiday, and beginning on Monday at 7:00 a.m. and ending on the following Friday at 6:00 p.m.
