A. 
It shall be unlawful for any person to have in his possession any container of any sort, whether open or unopen, containing any alcoholic beverage, as defined by § 3 of the New York State Alcoholic Beverage Control Law, in any City-owned park or recreational facility, except that, pursuant to rules and regulations duly promulgated by the Commissioner with the approval of the Mayor, alcoholic beverages may be permitted in certain City-owned parks or recreational facilities or designated areas of such parks or facilities. Said rules and regulations may impose such terms and conditions, including but not limited to an application form, permit and fee, as the Commissioner, in his discretion, may direct, and they shall be effective 48 hours after they have been posted in the office of the City Clerk.
B. 
It shall be unlawful for any person to have in his possession any open container of any sort containing any alcoholic beverage, as defined by § 3 of the New York State Alcoholic Beverage Control Law, on any area to which the public is invited and which is not fully enclosed, which shall include public shopping center areas and public areas of apartment houses, condominiums and cooperative apartment house complexes and private streets open to public vehicular traffic as well as those areas designated as subject to traffic regulations as provided by § 109-27 of the Code.
