A. 
The title of this chapter shall be "A Law Authorizing the Establishment of the Tenant Selection Advisory Committee To Provide Advice and Make Recommendations to the Town Board."
B. 
Short title. This chapter shall be known and may be cited as the "Tenant Selection Advisory Committee Law."
This Tenant Selection Advisory Committee Law is adopted for the purpose of establishing the Tenant Selection Advisory Committee as an advisory body to the Town Board to assist in the administration of affordable housing units as set forth by § 322-101.
A. 
Scope and meaning of certain words and terms.
(1) 
The word "shall" is mandatory and not directory.
(2) 
The word "may" is permissive.
B. 
Definition of terms. As used in this chapter, the following terms shall have the meanings indicated:
AFFORDABLE HOUSING UNIT
A dwelling unit under § 322-101, which is set aside for qualifying senior citizens.
TOWN BOARD
The Town Board of the Town of Smithtown, Suffolk County, New York.
A. 
A Tenant Selection Advisory Committee is hereby established which shall consist of five members. All members of the Tenant Selection Advisory Committee shall be appointed by the Town Board for terms of three years. A vacancy shall be filled for any remainder of an unexpired term in the same manner as an original appointment. The Tenant Selection Advisory Committee members will serve without compensation.
B. 
The Tenant Selection Advisory Committee shall select from its own members a Chairman and shall meet as necessary to assist the Town Board with the tenant selection process for affordable housing units. Meetings shall be at the call of the Chairman or upon the request of four members of the Town Board. Three members shall constitute a quorum for the transaction of business. All decisions of the Committee shall be by majority vote.
A. 
The Tenant Selection Advisory Committee shall act as an advisory body to the Town Board in connection with the implementation of this chapter and its purposes. The Tenant Selection Advisory Committee shall study and review the operation of this chapter and all administration thereof for the purpose of formulating and recommending guidelines to the Town Board regarding eligibility and selection procedures for the affordable housing units, and shall perform those administrative tasks which the Town Board directs the Tenant Selection Advisory Committee to undertake.
B. 
The Town Board will retain authority and jurisdiction over the selection of tenants for the affordable housing units.
