Annual leave is paid leave granted to eligible employees for their personal use. Merit and appointed employees are eligible for annual leave in accordance with the terms of this Article
XV. Contractual employees are eligible for annual leave only if such leave is granted by an express term of their employment contract.
Employees may carry over into a new year a maximum of 30 days (total) of annual leave. This carryover shall be accomplished effective the first day of the fiscal year. Any excess annual leave over this amount is lost. Upon separation from Town service for disability or nondisciplinary reasons, when employees give proper notice, nonprobationary employees shall be paid for their accrued annual leave in accordance with Article
IX, Separation of Employees, of this Division A. This payment shall be withheld for employees who do not give proper notice unless the Mayor, at his sole and absolute discretion, authorizes such a payment. Any such authorization by the Mayor shall be evaluated on a case-by-case basis, and in no event shall any such authorization establish a precedent or constitute a policy.
Employees must receive prior approval from their supervisor
before using their leave. Leave is not a right but a privilege, and
will be approved or disapproved based upon the operations and work
load of the department, the employee's leave record, and in consideration
of the leave requests from other employees. If the Town has not acted
on a request in advance of the date the leave is to begin, the failure
to act does not constitute approval. The employee must use other approved
leave, change his plans, or be placed in an absent-without-leave status
and subject to disciplinary action.
