The Mayor shall appoint three persons not otherwise employed
by the Town to serve on the Grievance Board, designating one person
to serve as the Chairperson. Members of the Town Council may not be
appointed to the Board. It shall not constitute a disqualification
to appointment to the Grievance Board if the individual serves on
another board or commission of the Town as long as the individual
receives no compensation for such services. The Mayor shall also appoint
an alternate member to serve on the Grievance Board when a member
cannot serve.
The Grievance Board shall have the authority to convene for
the purposes of receiving evidence and argument on a "grievance" as
defined by this Personnel Ordinance. The Grievance Board is authorized
to hear only those employee complaints defined by the Personnel Ordinance
as grievable issues. The Grievance Board may interpret the meaning
and intent of the Personnel Ordinance, if such a determination is
necessary for the resolution of the grievance. If the Grievance Board
makes an interpretation of the Personnel Ordinance, it shall include
the basis of such interpretation in its findings, conclusions and
recommendations to be forwarded to the Town Council. The Grievance
Board is authorized to implement and enforce its rules of procedure,
so long as such rules do not conflict with the Personnel Ordinance.
The Grievance Board is not authorized to enact substantive rules or
regulations.
Three members are necessary to constitute a quorum and transact
the business of the Grievance Board. The findings, conclusions, and
recommendations shall be by a majority vote of the Board. The Chairperson
of the Board shall draft a written report of the findings, conclusions,
and recommendations of the Board and transmit the report to the Town
Council in a manner which ensures the confidentiality of the report.
