No billboard, sign, poster, advertising display or other structure
designed for the purpose of displaying outdoor advertising matter
shall be erected, constructed or maintained in the Town of Chesapeake
Beach until a permit shall have been obtained therefor and fees hereinafter
provided for are duly paid.
Any person, firm or corporation desiring to erect, construct
or maintain any such billboard, sign, poster, or advertising display
shall submit to the Town Public Works Administrator a written application
for a permit to erect, construct or maintain the same, which application
shall state the location of the property upon which the same is to
be erected, constructed, or maintained, and indicate by diagram or
otherwise the exact location thereof, the name of the owner of the
premises upon which the same is to be erected, the authority of the
applicant (if not the owner) to erect, construct or maintain the same,
the size of the proposed existing sign or other structure, and the
content of the advertising to be displayed thereon. Such application,
and a tax of $15 for each and every sign so erected, constructed or
maintained, provided that such tax shall not be paid with respect
to any sign devoted exclusively to the place of business located on
the property, and provided further that no permit shall be required
with respect to a sign on real estate devoted exclusively to advertising
the same for sale or rent.
If any billboard, sign, advertising display or other structure
shall be erected or maintained contrary to the provisions hereof,
the owner of such billboard, sign, advertising display or other structure
shall be given five days' notice to remove such billboard, sign, advertising
display or other structure. If such billboard, sign, advertising display
or other structure is not removed after such five days' notice, the
Public Works Administrator and/or the police authorities of Chesapeake
Beach shall be authorized, empowered and directed to remove such billboard,
sign, advertising display or other structure.
Any person, firm or corporation violating any provisions of
this article or who or which shall fail, neglect or refuse to procure
a permit required by the same shall, upon conviction, be fined not
more than $100 or, in default of the payment thereof, be imprisoned
in the County Jail for not more than 25 days.
