The following sewer allocation policy shall be adopted for all
future connections within the Town boundaries, except connections
for single-family homes which are not part of a multi-unit development.
Allocations will be based on an equivalent dwelling unit (EDU)
being equal to 250 gallons per day (GPD).
Allocations will be granted upon written request from the property
owner issued to the Town Council of the Town of Chesapeake Beach.
Application for allocations shall be made by the owner for a designated
piece of property only.
The Town Council will approve allocations based on the unused
plant capacity assigned to Chesapeake Beach, projected needs for future
single-family lot connections within the Town boundaries and other
factors deemed appropriate by Town Council. There will be a reserve
for future single-family lot connections.
Sewerage allocations approved by the Town Council must be secured
by the owner within 15 days from notice of said allocation by the
nonrefundable deposit of 10% of the Town's sewer capital connection
charge.
At the end of a one-year period and at the end of each one-year
period thereafter, the allocation will be cancelled and the deposit
forfeited unless the owner elects by written notification to Town
Council to continue the allocation and the following conditions are
met:
A. The Town Council is satisfied that the owner's project is being planned
and appropriate permits and approvals are being sought from local,
county and state agencies; and
B. The owner deposits with the Town an additional 10% of the sewer capital
connection charge then in effect.
All deposits paid by the owner are nonrefundable and nontransferable
to properties other than those for which they were allocated.
At the time the owner desires to connect to the sewer system,
the owner must pay the Town all remaining monies due for the sewer
capital connection charge (based upon current charge at time of connection
minus previous deposit payments) and other charges called for in the
Town's Water and Sewer Policy Manual.
If, due to circumstances beyond its control, the Town is unable
to provide sewer capital connections to any owner who has reserved
same pursuant to this article, all deposits paid by the owner shall
be refunded in full, and no liability shall be incurred by the Town
for the failure to provide the desired connections.
