JITNEY
An autobus for hire, and includes any motor vehicle engaged in carrying individual passengers for hire which is or are operated over and upon the public streets of the City of Atlantic City, except motor hearses, motor ambulances, minibuses used by hotels, taxicabs and motorbuses operating from stands or garages or operating from fixed locations upon telephone calls, which vehicles shall not be construed to mean autobuses commonly called "jitneys."
PERSON
Includes a person, firm or corporation.
STREET
Includes any street, alley, avenue, court, land or public place in the City of Atlantic City utilized for vehicular jitney traffic.
A. 
Before operating any jitney along, through, over and upon any street of the City of Atlantic City, the owner shall obtain consent, in the form of a license, from the Director. The Director shall cause a certificate of ownership to be issued, in a form acceptable to the City Solicitor, to all present holders of jitney licenses in accordance with present City records. Said certificate shall constitute evidence that the holder thereof is a jitney licensee in accordance with and subject to all applicable ordinances of the City of Atlantic City. Thereafter, as licenses are approved for transfer by the governing body of the City of Atlantic City, the Director shall require the transferor to surrender his certificate of ownership and issue a new certificate of ownership to the transferee upon approval of the transfer by the governing body of the City of Atlantic City. The certificate of ownership shall contain thereon a conspicuous indication therein with respect to the interest of any secured party that may have a security interest in and to the license in accordance with Subsection J below. No jitney license that is subject to a security interest shall be issued a new certificate of ownership upon transfer unless satisfactory proof is presented to the Director indicating that the security interest has been endorsed for discharge or cancellation. In no event shall the provisions of this subsection in any way place any obligation or responsibility upon the City of Atlantic City or any of its agents, servants or employees to determine whether security interests are validly created or perfected, as that shall be governed exclusively by the applicable provisions of the New Jersey Uniform Commercial Code, N.J.S.A. 12A:1-101 et seq.

Licenses shall be renewed every year, and an annual fee of $150 shall accompany all applications for renewal.

D. 
In the event that a license is transferred and/or sold, the individual to whom the old license is transferred and/or sold shall pay a one-time initial licensing fee of $700. Said fee shall accompany all requests to the Division for approval.
E. 
All applications for license renewal or transfer shall be made in writing and filed with the Director. Transfer application forms may be submitted to the Division with all information complete accept the supporting documentation with a nonrefundable fee of $100 in order for the Division to begin the review process. If the transfer application is properly supplemented with the additional required information within 90 days of the date of original submission, the one-hundred-dollar fee shall be applied to the transfer fee. If the supplemental transfer application information is not received in the ninety-day period or if the transfer application is denied, the one-hundred-dollar fee shall be retained by the City. No Application will be approved by the Division unless it is accompanied by the appropriate fees and contains the information required in the application and the following:

(1) 
The type of motor vehicle, the name of the manufacturer and the date when the jitney will be in operation, such time not to exceed 60 days from the application approval date unless written consent is received from the Director.
(2) 
Proof that the seating capacity of the motor vehicle, according to its trade factory rating, is intended to accommodate 13 passengers.
(3) 
The name, age, residence and business address of the applicant.
(4) 
The New Jersey vehicle registration number, vehicle insurance policy particulars and a valid New Jersey driver's license of the owner-operator of the jitney and, if an application for a license transfer, a valid New Jersey driver's license of the transferee.

(5) 
A complete description of the vehicle, both inside and out, including whether the vehicle has been converted for jitney use and, if so, the name and place of business of the individual doing the conversion.
(6) 
If an individual, the applicant shall be photographed by the Director or his designee for the purpose of preparation of an identification card to be executed by and showing the identity of the actual owner of the license.

(7) 
If a corporation, partnership or limited liability company, the applicant shall have its corporate officer, partner or member, as applicable, be photographed by the Director or his designee for the purpose of preparation of an identification card to be executed by and showing the identity of the actual owner of the license.

(8) 
The license applicant shall affirm that the jitney business and/or license shall not be used and operated for unlawful purposes and shall comply with applicable laws.

F. 
The signature of the person making application shall be verified before a notary public or some other person fully authorized to administer oaths, and said applicant shall be recommended by two reputable residents of the City of Atlantic City as a person of good moral character, temperate in habits and a fit person to be licensed.
G. 
No license to own or operate any jitney shall be granted to any person under the age of 21 years, without having had a New Jersey driver's license for a period of three years.
H. 
It shall be unlawful for any person to drive a jitney within the City of Atlantic City without first having obtained a jitney license and an identification card, the latter to contain the photograph and signature of the licensee. All applicants shall provide such information as the Director requires, including but not limited to fingerprinting and a criminal record check. This identification card shall be carried at all times and prominently displayed while driving or operating a jitney. It shall be unlawful for any jitney operator or licensee to permit anyone else to wear his or her identification card or to refuse to show the same to lawful authorities upon request. A fee of $10 shall be charged for each identification card upon annual renewal and $15 for a replacement.

(1) 
To provide for a timely and efficient criminal history background review, the City of Atlantic City will be utilizing the state-police-coordinated, non-criminal-justice fingerprinting process known as "Live Scan." The State of New Jersey has contracted with a vendor, Sagem Morpho, Inc., to perform this service. The company has established permanent sites throughout the state as well as several mobile units available to meet its contractual agreement. Sagem Morpho charges a fee for the fingerprinting for which the applicant will be responsible. There will be an additional fee of $20 payable to the City of Atlantic City, for the processing of the fingerprint documentation required by Sagem Morpho.
I. 
No license shall be granted to any person to operate a jitney who has not legally operated an automobile for at least three years prior to the application for a jitney license and who has not satisfied the Department of his or her ability to drive a jitney, such fitness to be determined by actual driving tests, if necessary. An operator's physical and mental capabilities must also be ascertained.
J. 
Transfers, conditional sales and other liens.

(1) 
Transfers of jitney licenses shall be permitted, provided that there is compliance with all other terms and conditions set forth in this article.
(2) 
Security interests in and to jitney licenses shall be permitted, whether for purposes of financing jitney license acquisitions or otherwise. Where a security interest is given, the secured party shall file with the Director a copy of the security agreement, a financing statement in compliance with the Uniform Commercial Code and the promissory note or other writing evidencing the indebtedness which the license secures. When these documents are filed with the Director, any subsequent application to transfer the affected license shall, if otherwise approved, automatically be conditioned upon satisfaction in full of the indebtedness which the license secures, and written proof of such satisfaction shall be filed with the Director within 10 days of approval of the transfer.
(3) 
Interests in and to jitney licenses may, in addition to being transferred voluntarily, also be transferred involuntarily by way of levy and execution, or in such other manner as may be authorized by law. If an authorized and licensed lending institution shall acquire an interest in and to a jitney license by way of execution in the manner prescribed by law, the lending institution shall thereafter promptly expose the license for sale and thereafter diligently pursue the sale of the same with the intent that it ultimately be transferred to an individual. Any individual who ultimately acquires said license from a lending institution shall comply with the procedures and requirements of this article; however, the lending institution shall not be required to pay any licensing fees in order to have the license transferred to it, provided that it has acquired the license as a levying creditor in the manner prescribed by law. Any lending institution that acquires a jitney license shall not be permitted to use said license in connection with the operation of the subject jitney bus until the license is transferred to an individual.
(4) 
Security interest in and to jitney licenses that may hereafter be created pursuant to applicable state law shall be conspicuously noted on the certificate of ownership for each and every jitney license issued by the Director. No new certificate of ownership shall be issued by the Director upon the transfer of any jitney license unless there is presented to the Director, in the case of any security interest noted on a certificate of ownership, proof satisfactory to the Director that the security interest has been endorsed for discharge or cancellation.

(5) 
Neither the City nor the Director or the Division shall be deemed a party to any transfer undertaken pursuant to any provision of this section, and no liability for any action or inaction on the part of the City, the Director or the Division shall accrue as a result hereof.

A. 
Upon receipt of each application, whether for an original license or for a renewal or transfer, the Director shall cause an investigation to be made by the Department Inspectors of each application and shall, depending on the results, either recommend the granting or the refusal of the same.
B. 
After a sale and transfer of a jitney and jitney license and approval of same by the governing body as required in § 233-28, the Director shall issue a new certificate of ownership to the transferee only upon presentation of a valid New Jersey title certificate and registration and insurance card. No jitney license shall be recommended or awarded to an applicant by the Director if it appears that:

(1) 
The insurance policy required by law has not been furnished and approved, or the same is insufficient in form or substance to properly safeguard the public interest and safety, or that the policy of insurance is not operative for at least one year;
(2) 
The vehicle which the license is applied for is inadequate or unsafe for the purpose intended or is insufficiently equipped in any manner whatsoever, as determined by a personal inspection of the vehicle carried out by a qualified agent of the Department, which deficiencies are set down, in writing, and delivered to the Director; or
(3) 
The applicant has not complied with all the terms and conditions of this article and of the State of New Jersey relevant to such cases or the applicant is not such a person entitled to be licensed hereunder.
C. 
The license to own and operate a jitney may be revoked by the Director for a violation of any of the provisions of this article or any ordinance of the City of Atlantic City relating to traffic use of streets or for the violation of any state law relating to traffic or use of streets or for failure to pay any judgment for personal damages arising from the unlawful or negligent operation of a jitney for which the license was issued or for failure to pay any franchise taxes provided by law, and, thereupon, all rights and privileges under said license shall terminate.
D. 
Before any license shall be revoked, the holder thereof shall have been notified, in writing, of the reasons for revocation and shall be given a public hearing, at which the licensee may be represented by counsel. In addition, the licensee shall be given five days' notice of the time and place of such hearing. The notice provided hereby shall be served personally or mailed to the address last filed by the person licensed in the office of the Director. It will also be within the discretion of the Director to levy a fine and/or suspension, should the Director deem revocation too severe a penalty.
E. 
Where a licensee has been convicted of a crime in any City, county, state or federal court, upon conviction, the Director may revoke the license of the jitney owner upon notice and hearing.
F. 
For the purpose of this article, the Director is assigned the supervision over the operation of all jitneys upon public streets in the City of Atlantic City to assure the safe and timely operation of all jitneys.
G. 
The Director shall take official cognizance of any and all misconduct, deceit, fraud, subterfuge or actions of any jitney licensee which are against the best interest of the public or the jitney industry itself, regardless of whether or not such actions are specifically covered in this article. It shall also be the direct responsibility of all Department Inspectors to bring such actions to the notice of the Director.
H. 
It shall further be the duty of the Director to take all reasonable and prudent steps to assure that the terms and conditions of this article are fulfilled, both with regard to the appointment and supervision of qualified personnel, as well as the timely promulgation of all necessary departmental procedures, such as (but not limited to) the publication of penalty charts, fines to be levied and any and all other disciplinary measures to be undertaken by the Department.
Signs indicating the location of jitney stops approved by the Atlantic City Police Department in consultation with the Jitney Association are subject to approval by the Director of Planning and Development and/or his or her designee.

A. 
As the result of the excellent services rendered over the years to Atlantic City residents and visitors alike, the A.C. Jitney Association is hereby recognized as the official representative of jitney owners.
B. 
All licensed jitney owners must be members of the A.C. Jitney Association.
C. 
The Jitney Association shall have the responsibility of determining its own internal rules of operation, subject to the concurrence of the Director.

A. 
The holder of any license shall not substitute or replace any licensed and approved vehicle without the written approval of the Director, unless the substituted vehicle had already received such approval.
B. 
It shall be unlawful for the holder of any license issued under this article to transfer the same to any person without the specific written approval of the Director and a resolution from the City Council.
It shall be unlawful for any person making application for any license or identification card to willfully make any false statement as to any of the matters required to be stated in such application. False statements are grounds to deny or revoke a license.
A. 
It shall be unlawful to drive or operate any jitney while that jitney is carrying more than 13 passengers. Upon accepting passengers for boarding, drivers shall assure that each passenger is, if not seated, secured before commencing operation of the jitney bus.

B. 
Passengers must be treated with courtesy and respect; repeated complaints against drivers will be grounds for disciplinary action, initiated by the Director.
C. 
For the purpose of this article, children in arms shall not be considered as persons.
A. 
It shall be unlawful for any person to operate or drive any jitney under the license provided in this article when the streets are covered with snow and ice unless the rear wheels thereof are equipped with adequate nonskidding devices or tires.
B. 
The use of any jitney which may be found by an Inspector to be unsafe or not in condition to properly carry passengers shall be discontinued from service until such time as it is repaired, made safe or put in good condition before being again used.
It shall be unlawful for any person to engage in the business of operating a jitney from place to place and along a specified route and between specified termini under the license provided in this article unless he shall carry night and day, on the inside of said machines, a sign giving the route to be traversed, the official jitney stops, the terminus of said route, the price of the fare charged and the number of the jitney, which number shall be conspicuously displayed on the inside and outside of said machine.
A. 
It shall be unlawful for the operator of any jitney to bypass any prospective customer when there is space available on his jitney. Any complaints concerning the bypassing of a prospective customer by a jitney operator shall be processed and handled by the Municipal Court.
B. 
However, the person driving or operating a jitney shall refuse transportation to any person who is in an intoxicated condition or bearing any open container which holds alcoholic beverages or to any person who at such time may be conducting himself in an unruly or boisterous manner or using profane or obscene language.
A. 
On all authorized jitney routes there shall be charged a cash fare of $3, and there shall be established a frequent rider program, through which a book of 10 coupons may be purchased for $20, one coupon being the value of one fare. Said coupons shall be made available at three centralized locations within the City of Atlantic City, said locations to be approved by the Director.

B. 
The fare for senior citizens, as provided under the laws of the State of New Jersey, specifically N.J.S.A. 27:1A-64 et seq., and the rules and regulations of the New Jersey Department of Transportation, shall be $0.75, provided the tickets are purchased as required by the aforesaid laws, rules and regulations. Said reduced fares shall apply 24 hours a day, seven days a week.

Upon approval of the Director, temporary special event fares or special shuttle fares in an amount not to exceed the lowest existing fare may be established. Rate request must accompany the petition for this type of service. If the rate is deemed inappropriate, service may be denied unless the rate is restructured. Such fare shall be one-way point-to-point nonstop.

It shall not be lawful to license or operate any jitney as classified under Chapter 136 of the Laws of 1916 of the State of New Jersey,[1] and the several supplements and amendments thereto, except as follows:
A. 
Green Route:
(1) 
Eastbound: Jackson to Pacific Avenue; Pacific Avenue to New Jersey Avenue; right on New Jersey Avenue to Oriental Avenue; left on Oriental Avenue to Massachusetts Avenue; left on Massachusetts Avenue to Pacific Avenue; right on Pacific Avenue to New Hampshire Avenue; left on New Hampshire Avenue to Melrose Avenue; left on Melrose Avenue to Route 30; Route 30 to Brigantine Boulevard to Golden Nugget; Golden Nugget to Harrah's, ending at Borgata.
(2) 
Westbound: Borgata to Brigantine Boulevard to Route 30; Route 30 to Melrose Avenue; Melrose Avenue to New Hampshire Avenue; right on New Hampshire Avenue; New Hampshire Avenue to Pacific Avenue; right on Pacific Avenue to Connecticut Avenue; left on Connecticut Avenue to Oriental Avenue; right on Oriental Avenue to New Jersey Avenue; right on New Jersey Avenue to Pacific Avenue; left on Pacific Avenue ending at Jackson Avenue.

Yellow Route: Commencing at the designated jitney stop at Borgata Casino and proceeding northeast on or over the Borgata's service road to Harrah's Casino service road; on or over Harrah's service road in a southerly direction to Brigantine Boulevard; on or over Brigantine Boulevard in a southeasterly direction to Harrah's Casino designated jitney stop; proceed south on or over Harrah's service road to Brigantine Boulevard; on or over Brigantine Boulevard in a southeasterly direction to Huron Avenue; make a left turn into Trump Marina and proceed to Trump Marina designated jitney stop; from Trump Marina proceed to Huron Avenue in a westerly direction to the entrance of the Borgata Casino service road; on or over the Borgata service road to the designated jitney stop at the Borgata.
D. 
Train Station Direct Service Routes. The Atlantic City Jitney Association, as defined under its agreement with NJ TRANSIT, is authorized to provide free shuttle service to all passengers riding the train into Atlantic City. NJ TRANSIT passengers shall be transported by the Atlantic City Jitney Association from the train station to designated casinos. In order to handle passenger demands, special direct-route jitneys and DOT-approved twenty-eight-seat shuttle buses will service the routes. In the event the twenty-eight-seat shuttle buses break down, additional jitneys will be deployed to service the routes. The jitneys and shuttle buses will service the NJ TRANSIT trains seven days a week, 365 days a year, and are restricted to the following routes and stops:
(1) 
Route TS #1: Hilton, Tropicana, Trump Plaza, Caesar's and Bally Wild West (serviced by DOT-approved, twenty-eight-seat bus):
(a) 
Commencing at the train station and making a U-turn onto Kirkman Boulevard and proceeding on or over Michigan Avenue in a southerly direction to Atlantic Avenue. Proceed in an easterly direction onto Atlantic Avenue to Ohio Avenue. Proceed on Ohio Avenue in a southerly direction to Pacific Avenue. Proceed on Pacific Avenue in a westerly direction to Hilton Casino at Hartford Avenue. Turn right onto Hartford Avenue in a northerly direction and make a left turn in a westerly direction onto Atlantic Avenue. Proceed on Atlantic Avenue in a westerly direction to Albany Avenue. Turn left onto Albany Avenue and proceed in a southerly direction to the intersection of Albany Avenue and Pacific Avenue. Proceed and return in an easterly direction on Pacific Avenue to Michigan Avenue. Proceed in a northerly direction on Michigan Avenue to the train station to designated Route TS #1 stop.
(b)

A. 
To implement the above service, it shall be the duty of the Director to provide 190 jitney licenses at all times to guarantee safe, economical and convenient transport for the City of Atlantic City residents and visitors alike.
B. 
However, should increased ridership dictate that additional jitney licenses be issued beyond the ability of 190 operable licenses to provide adequate service, it shall be the duty of the Director to undertake to increase the number of licenses upon the submission of written reports to the Director, addressing the question of increased ridership and the need for new licenses, said reports to be compiled by the Department's Chief Inspector and the Atlantic City Jitney Association.
C. 
The Director shall then issue new licenses, provided that the following measures are undertaken in addition to all other stipulations previously set forth in this article:
(1) 
All applicants for a new jitney license must be residents of the City of Atlantic City for a period of six months prior to submitting their application.
(2) 
Applicants must demonstrate their financial competency to the satisfaction of the Director.
(3) 
Successful applicants will be selected by lottery.
(4) 
If there are not sufficient residents from the City of Atlantic City seeking new licenses, then the Director, at his discretion, may open up the lottery to residents of Atlantic County who have resided therein for six months.
(5) 
The fee for the new license shall be determined by taking an average of the last six sales of jitney licenses.
A. 
There shall be no smoking on jitneys.
B. 
Only licensed jitney owners can drive an authorized vehicle.
C. 
Only a licensed jitney can be used on a prescribed jitney route.
D. 
Unsanitary, inadequate, unclean or unsafe jitneys will not be permitted to operate.
E. 
Only one fare can be charged for each seat in the vehicle.
F. 
It shall be illegal to use profanity or engage in physical violence either on jitneys or in areas on or near jitney stops.
G. 
All accidents must be reported to the Division within 24 hours of the occurrence.
H. 
Jitneys must operate 24 hours a day, 365 days a year. It will be the responsibility of the Atlantic City Jitney Association to establish specific and acceptable schedules for all jitneys in accordance with the terms of this article and with the concurrence of the Director. There must be at least 10 jitneys on Pacific Avenue route at all times.
I. 
All lost and found articles not reclaimed by jitney passengers from the Jitney Association within 48 hours will be reported to the Division in writing.
J. 
Jitney owners must notify the Division when a change of license number or registration number occurs.
K. 
Jitney license numbers must be displayed on the rear window of the vehicle and also above the driver's head on the inside of the vehicle in clear view of the passengers.
L. 
It shall be unlawful for any person operating a jitney to drink intoxicating liquors or be under the influence of drugs of any kind while engaged in transporting passengers for hire.
M. 
Drivers must be neat and clean at all times. No shirts without collars are permitted. Bare feet are prohibited. Exterior tops and bottoms must be worn. Shorts (Bermuda style) may be worn between May 15 and September 15 subject to the approval of the Jitneymen's Association.
N. 
If a jitney breaks down and is unable to continue, passengers must be refunded their fares in full.
O. 
It shall be unlawful for any jitney to stop for the purpose of receiving or discharging passengers within 10 feet from the intersection of streets unless in the process of legally passing another jitney, and in all cases such embarking and disembarking passengers shall be at a point as near the curb as may be practicable.
P. 
When off duty, jitneys may not travel over a jitney route for more than three blocks.
Q. 
Each jitney shall display a sign(s) indicating the route(s) authorized by § 233-39 herein that said jitney is currently operating over. This sign must be on the front of the jitney and prominently displayed.[1]

R. 
Members of the Atlantic City Jitney Association shall be permitted to own a maximum of two jitney licenses and two jitney buses, provided that the governing body of the City of Atlantic City duly approves the jitney licenses and a mercantile license is obtained annually from the City of Atlantic City for each jitney bus and jitney license.

S. 
No member of the Atlantic City Jitney Association owning two jitney licenses shall be permitted to work more than one shift per day.

T. 
Under no circumstances shall an owner of two jitney licenses be permitted to sublease, sublet or otherwise rent for hire any jitney license, nor shall anyone other than the duly approved licensee be permitted to operate the jitney bus associated with the corresponding jitney license.

U. 
Members of the ACJA who own two jitney licenses and two jitney buses, provided that the governing body of the City of Atlantic City duly approves or has approved the jitney license and a mercantile license is obtained annually from the City of Atlantic City for each jitney bus and jitney license, for the purpose of economic viability and without a reduction in service, shall be permitted to register, insure and operate one jitney bus for all designated workdays.

V. 
The ACJA may, from time to time, acquire and hold up to 10 Atlantic City jitney licenses, upon written notice to the Director of Licensing and Inspections, to be held inactive and where all applicable license fees will be paid at time of acquiring, during the time the license is held, and at subsequent transfer.

W. 
Inactive licenses held by the ACJA may, from time to time, as necessary, be loaned to members at no fee who may need to perform maintenance on their vehicle and would not be able to make their scheduled routes otherwise upon notice to the Director of Licensing and Inspections.

X. 
Transfers of inactive licenses by the ACJA will be made only to purchasers who submit a jitney transfer license application to the Department of Licensing and Inspections, and are approved pursuant to Atlantic City Code § 233-28.

In the event of a transportation crisis (either natural or man-made) or a public safety emergency, the Director, upon first declaring such a crisis, shall have the authority to direct all available jitneys to operate in such a way as to alleviate the crisis conditions without regard to the specific routes or regulations as prescribed in this article, provided that he seeks the concurrence of the Mayor at the earliest opportunity. Under an emergency, the Mayor can order the Director to schedule jitneys as needed.
A. 
The Atlantic City Chief of Police shall approve an official list of jitney stops which may be amended from time to time by the Chief in consultation with the City Engineer and the Jitney Association. Every jitney shall prominently display said jitney stops inside the vehicle for the information of the riding public. The list of stops as amended shall be kept on file in the City Clerk's office.

B. 
All stops in hotel/casino complexes and within the Marina Area shall be mutually agreed to by representatives of the Jitneymen's Association and the Police Department.
C. 
With respect to the routes set forth in § 233-39 of this article, taxicabs may pick up fares at the jitney stops indicated in said route so long as the fare initiates action to indicate to the cab driver by hailing or in some other fashion that said fare desires the services of a taxi and is not waiting for a jitney. It shall be prohibited for a cab to stop in a jitney stop unsolicited for purposes of taking on or discharging a fare.
D. 
The Jitneymen's Association shall be responsible for the furnishing of the signs at all jitney stops.

B. 
Jitneys shall stay on their prescribed routes. There shall be no turnoff points, even if the jitney is empty.

C. 
Passengers shall be picked up or discharged only at an official jitney stop, except when the vehicle is halted at a red light.
D. 
Drivers may pass another jitney which is not maintaining the current speed limit.
E. 
When pulling into the near side to discharge or pick up passengers, in order to keep the lead, the rear wheels of the jitney must be across the intersection. When pulling into the far side of a jitney stop to pick up or discharge passengers, in order to keep the lead, the front of the jitney must be in the middle of the block.

Any person who shall violate any of the provisions of this article shall, upon conviction, be punished by a fine not to exceed the sum of $2,000 and imprisonment for a period not exceeding 90 days.
This article is necessary by reason of the congestion to traffic and danger to passengers and pedestrians obliged to use Pacific Avenue and other streets, resulting from the operation of jitneys. This article is also enacted for the immediate preservation of the public peace, health and safety of the citizens of the City of Atlantic City.
