The Town, acting through its legislative body, shall establish, and may from time to time revise, fair and reasonable charges for the use of the water system. Such charges shall result in the distribution of the cost of operation and maintenance in proportion to a customer's use of that system.
Bills for water service shall be rendered periodically in accordance with the applicable rate schedule. Such bills are due within 30 days of the billing date.
The WSA shall determine what constitutes waste or improper use and impose restrictions when necessary. The customer is responsible for all leaks and water on his property and in the service pipe and shall make payment for all water as registered by the water meter and any leaks in the service pipe as may be estimated by the WSA. The WSA neither assumes nor recognizes any part of the care of or responsibility for any water fixtures, or the use or waste of water on any metered premises. Any omission or delay of the WSA in sending a courtesy notice to any customer or property owner regarding a wrong or wasteful condition on their metered premises shall not be construed as implying or involving any such care or responsibility.
When necessary to conserve supply, the WSA may restrict or prohibit the use of water.
The bypassing of water meters or other use of unmetered water, except for fire fighting purposes, is a fraudulent use and water service will be discontinued immediately. Charges for such quantities as the WSA shall estimate to have been fraudulently used shall be assessed by the WSA in accordance with the full flow capacity of the bypass pipe and paid by the customer. Specific examples of fraudulent include delivery through unauthorized piping, unauthorized sale of water, and the existence of unscaled bypass valves.
A. 
Charge for reconnection. A charge will be made for reconnection when water service or private fire protection service has been disconnected for any reason including, but not limited to, the reasons listed in Article XIII. Service will be restored only if the conditions specified in Article XIII are remedied.
B. 
Temporary disconnection. When possible, water will be turned on or off during regular working hours at the customer's request to allow work on the plumbing of the premises and no charge will be made if adequate notice is given to the WSA. This service is performed as a courtesy. If the service is requested after regular working hours, the actual cost of the work including equipment, labor, and vehicles will be charged to the customer.
C. 
Vacancies, Customers shall notify the WSA when premises become vacant and shall request that the meter be removed and water shut off at the curb or shall be charged for an estimated amount of water usage based on past usage. If the WSA is notified of a vacancy, the service will be turned on and off during normal working hours at no charge to the customer. The WSA may terminate service to any premises that, to the best of its knowledge, is vacant.
D. 
Seasonal use. A customer requiring the setting and disconnection of a meter, because of seasonal use, may be billed for each call.
A. 
No use charge shall be established or revised until after a public hearing conducted by the legislative body at which time the customers and owners of premises against which such charges are to be levied shall have an opportunity to be heard concerning the proposed charges. Notice of the time, place and purpose of such hearing shall be published at least 10 days before the date thereof in a newspaper having a substantial circulation in the Town. A copy of the proposed charges shall be on file in the office of the Town Clerk and available for inspection by the public at least 10 days before the date of such hearing.
B. 
Subsequent to the public hearing, the proposed charges shall become effective if approved by a majority of the members of the legislative body present and voting at a regular or special meeting of the legislative body and after publication in a newspaper having a substantial circulation in the Town.
The owner of premises against which any use charge is levied shall be liable for the payment thereof. Service may be disconnected for nonpayment of any bill for service, including late payment charges.
Failure to receive a bill does not relieve a customer of the obligation to pay the bill and late charges, nor does failure to receive a bill relieve the customer from the consequences of nonpayment.
