A. 
The laying out of any new street or public highway shall be approved as to name, location, width, lines and grade by the Borough Council before the acceptance thereof as a public street of the Borough of Swedesboro.
B. 
Streets shall be brought to grade, and acceptable curbs shall be in place before the acceptance thereof as Borough streets.
C. 
Allen Street, as extended northwesterly from Third Street to Vanneman Avenue; Moore Place, as laid from Second Street southeasterly to Auburn Avenue; Mayhew Avenue, as laid out from Turner Street southwesterly to South Street; South Street, as laid out from Mayhew Avenue southeasterly to Main Street; and the streets indicated on a certain line and grade map, as prepared by William M. Carter C.E., for the Borough of Swedesboro and dated 1905, namely, Allen Street, Ashton Avenue, Auburn Avenue, Anderson Avenue, Broad Street, Bridgeport Avenue, Chestnut Street, Church Street, Colon Street, East Avenue, Ferry Road, Fow Avenue, Guest Avenue, Glass House Street, Grant Avenue, Glen Echo Avenue, Helms Avenue, Lake Avenue, Locke Avenue, Leahy Avenue, Mill Street known as Franklin Street, Main Street, Mechanic Street, Mayhew Avenue, Park Avenue, Poplar Street, Railroad Avenue, Richardson Avenue, Second Street, Third Street, Turner Street, Thompson Avenue, Vannerman Avenue, Weatherby Avenue, Water Street and Woodstown Road, are hereby acknowledged as Borough streets and Subsections A and B of this section shall not apply to the same.
A. 
The paved portion of any sidewalk, provided that the width of the street permits, shall be not less than four feet in width.
B. 
The full width of said sidewalk from property line to curbline shall remain unobstructed, unless special privilege is secured from the Borough Council.
C. 
The grade of the sidewalks, regardless of the material of construction, shall have a uniform pitch of 1/4 of one inch to the foot toward the curbline, except where the physical conditions alter the situation and, in such case, modifications must first be approved by the Borough Council.
D. 
The material for paved portions of sidewalks shall be concrete, and the alignment, grade, construction and ingredients shall correspond to the provisions of this article. In all cases where the subgrade shall be of a clay or spongy nature, there shall be an additional excavation to a depth of four inches below the base of the improved pavement and said space filled and well tamped with sand or cinders.

E. 
Concrete sidewalks shall be a minimum of four inches thick and a minimum of six inches thick adjacent to driveways, and the concrete shall have a minimum strength of 3,500 pounds per square inch in accordance with the Borough Engineer's specifications. The construction of said sidewalks shall in all other respects comply with design, improvement or construction requirements set forth in Chapter 290, Subdivision of Land, of the Code of the Borough of Swedesboro.

Concrete curbs shall be a minimum of six inches by eight inches by 11 inches, and the concrete shall have a minimum strength of 3,500 pounds per square inch in accordance with the Borough Engineer's specifications. The construction of said curbs shall in all other respects comply with design, improvement or construction requirements set forth in Chapter 290, Subdivision of Land, of the Code of the Borough of Swedesboro.
All corners shall be rounded with a ten-foot radius, unless otherwise ordered in writing by the Borough Engineer. All corners shall be protected by a steel bar at the upper outer edge thereof commonly known as a "nose bar." All curbs and sidewalks lying within the intersection of the side lines of intersecting streets will be paid for by the Borough upon certification as to location and measurements by the Borough Engineer.
All driveways shall slope from the grade of the outer edge of the paved portion of the sidewalk to the gutter grade of the curbline.
A. 
All curbs and sidewalks shall be laid at the established grade, and the paved portion of the sidewalk shall be placed in the center of the total sidewalk area, unless otherwise directed in writing by the Borough Engineer and Chairman of the Street Committee or by the Borough Council.
B. 
The owner or owners of lands fronting or bordering on all the public streets of the Borough of Swedesboro are hereby required to construct, pave, repair, curb, recurb, improve and/or repair, at his or their own proper cost and expense, the sidewalks on both sides of said public streets of the Borough of Swedesboro in accordance with the provisions of this article; provided, however, that nothing herein shall be construed to affect any sidewalks and curbs on said streets now in good repair and constructed at said grade or slope and substantially in accordance with this article and subject to the provisions of § 285-6 of this article.
C. 
Upon the failure of the owner or owners of lands fronting or bordering on any public street to construct, pave, repave, curb, recurb, improve and/or repair the sidewalks within 30 days after service of notice of such contemplated improvement in accordance with the provisions of an Act of the Legislature of the State of New Jersey entitled "An Act Concerning Municipalities," approved March 27, 1917, and the acts amendatory thereof and supplemental thereto, it shall be lawful for the Council of the Borough of Swedesboro to cause such improvement to be made under the supervision of the proper officers of said Borough.
Prior to the work of laying any curb or sidewalk or any repair which exceeds 25% of the total length of said curb or sidewalk on any one property, a permit shall be obtained from the Borough Clerk, which permit shall state the location, together with the lineal frontage of the proposed work, and the name of the owner and of the contractor, if any, and the fee for such permit shall be as set forth in Chapter 140, Fees. Said permit shall expire in 90 days from the issuance thereof, and no person shall do any such work without obtaining such permit. Where such permit is granted, the line and grade will be furnished by the Borough Engineer at no expense to the property owner. Such work shall be inspected by the Borough Engineer of the Borough of Swedesboro and shall be finished in accordance with the provisions of this article and, when finished, shall be subject to approval by the Street Committee of the Borough Council upon the certification of the Borough Engineer.

The requirements for the construction of curb and sidewalks provided for in this article may be permanently waived by resolution duly adopted by the Mayor and Borough Council, upon certification by the Borough Engineer to the Mayor and Borough Council that one or more of the following conditions exist as to any given property:
A. 
When anticipated curb or sidewalk construction would be dangerous to pedestrian or vehicular traffic.
B. 
When construction of curb or walk is impractical by virtue of existing road profiles being excessively higher or lower than proposed road profiles such that the improvements would be buried or elevated, requiring extraordinary construction.
C. 
When the lot has frontage on two or more streets when one or more of the streets is unimproved and its improvement is not contemplated or its vacation is contemplated by the Mayor and Borough Council.
D. 
When the width of the municipal right-of-way is insufficient to contain curbs and/or sidewalks.
Any person who violates any of the provisions of this article shall, upon conviction thereof, be subject to the penalties as set forth in Chapter 1, Article I, General Provisions, § 1-15, General penalty.
