This Article 2 establishes minimum regulations governing the design, construction, alteration, enlargement, repair, demolition, removal, maintenance and use of all buildings and structures. It provides for the issuance of permits, collection of fees, making of inspections, and provides penalties for violations of the various codes and regulations adopted as part of this Chapter 14.
The International Code Council, Inc., 2015 Edition of the International Building Code and International Code Council, Inc., 2015 Edition of the International Existing Building Code are hereby adopted by reference, and are hereby made a part of this Article 2 with the same force and effect as if fully set forth herein, except, however, those exceptions, insertions and additions described in Section 14-2-3 of this Code. The International Building Code and International Existing Building Code, together with the International Residential Code for One- and Two-Family Dwellings (the Residential Building Code) set forth in Article 3 of this Chapter 14, are collectively referred to as the "Building Code" for the Village.
The following items are the additions, insertions and changes to the International Building Code:
Section 101.1 Title.
Delete all and insert "These regulations shall be known as the Building Code of the Village of Lincolnwood, hereinafter referred to as 'this code.' The Village of Lincolnwood shall be inferred whenever the term 'Village' is used in this code."
Section 101.4.3 Plumbing.
Delete all and insert "The provisions of the Illinois Plumbing Code, most current edition shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. All references to the International Plumbing Code throughout this code shall be replaced with the Illinois Plumbing Code, most current edition."
Section 101.4.6 Energy.
Delete all and insert "The provisions of the Illinois Energy Conservation Code, most current edition shall apply to all matters governing the design and construction of buildings for energy efficiency. All references to the International Energy Conservation Code throughout this code shall be replaced with the Illinois Conservation Code, most current edition."
Section 102.4.2 Provisions in referenced codes and standards.
Delete all and insert "Where the extent of the reference to a referenced code or standard includes subject matter that is within the scope of this code as well as the Illinois Plumbing Code, most current edition and the Illinois Energy Conservation Code, most current edition or the International Codes listed in Section 101.4, the provisions of this code as well as the Illinois Plumbing Code, most current edition and the Illinois Energy Conservation Code or the International Codes listed in Section 101.4 shall take precedence over the provisions in the referenced code or standard.
"1. All references to Chapter 11 Accessibility, any/all sections, throughout this code shall be referenced back to the Illinois Accessibility Code, most current edition."
Section 103.1 Creation of enforcement agency.
Delete all and insert "The Division of Building Safety, as part of the Community Development Department, is hereby created, and the official in charge shall be known as the Building Official."
Add (new section) 105.1.3 Failure to pick up an approved permit within six months.
Insert "Failure to pick up an approved permit within six months from time of initial permit submittal where contact was made to the applicant and/or owner to pay for, pick up and set up appropriate inspections, shall be deemed 'Work performed prior to issuance of permit' and subject to double the standard permit fees pursuant to the Village's Annual Fee Resolution,[1] and Section 14-14-6 of the Village Code."
Section 105.2 Work exempt from permit. Building:
Delete all and insert:
"1.
Painting, papering, tiling not in showers or bathtubs, carpeting, finish flooring, and other similar finish work but not including cabinetry and countertops where plumbing exists.
"2.
Prefabricated swimming pools accessory to a Group R-3 occupancy that are less than 24 inches (610 mm) deep, are not greater than 5,000 gallons (18,925 L) and are installed entirely above ground.
"3.
Swings and other playground equipment accessory to detached one- and two-family dwellings.
"4.
Nonfixed and movable fixtures, cases, racks, counters and partitions not over five feet nine inches (1,753 mm) in height."
Section 105.2 Work exempt from permit. Electrical:
Delete all and insert:
"1.
Repairs and maintenance: Minor repair work, including the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles.
"2.
Temporary testing systems: A permit shall not be required for the installation of any temporary system required for the testing or servicing of electrical equipment or apparatus."
Section 105.3 Application for permit.
Delete "department of building safety" and insert "Division of Building Safety."
Section 105.5 Expiration.
Delete all and insert "Every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 180 days after its issuance, or if the work authorized on the site by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. The Building Official is authorized to grant, in writing, one permit renewal or reissuance, for a period not to exceed 180 days. The renewal or reissuance shall be requested in writing and justifiable cause demonstrated. The Village Manager is authorized to grant, in writing, any subsequent permit renewals or reissuances, for periods not to exceed 180 days. Any subsequent renewals or reissuances shall be in writing and justifiable cause demonstrated. However, no permit or approval shall be valid for a period of more than one year after the date of issuance."
Add (new section) 105.8 Permit fee extension.
Insert "There shall not be any fee for the first renewal or reissuance of any permit that extends the validity of the initial permit for a period not to exceed 180 days. The fee for any subsequent renewal or reissuance of any permit that extends the validity of the initial permit for additional periods not to exceed 180 days shall be assessed at 25% of the original cost of the original permit."
Section 107.2.5 Site plan.
Delete all and insert "The construction documents submitted with the application for permit shall be accompanied by a site plan showing to scale the size and location of new construction and existing structures on the site, distances from lot lines, the established street grades and the proposed finished grades and, as applicable, flood hazard areas, floodways, and design flood elevations; and it shall be drawn in accordance with an accurate boundary line survey. In the case of demolition, the site plan shall show construction to be demolished and the location and size of existing structures and construction that are to remain on the site or plot. The Building Official is authorized to waive or modify the requirement for a site plan where the application for permit is for alteration or repair or where otherwise warranted. The site and grading plan shall be submitted in both paper and electronic versions."
Add (new section) 107.2.5.2 Compliance with site plan.
Insert "It shall be the responsibility of the builder/developer to submit to the Division of Building Safety a spot survey prepared by a registered land surveyor after the foundation is installed. This spot survey must be at a scale of not less than one inch equal to 30 feet. The spot survey must also indicate the elevation above sea level of the top of the foundation wall and the top of the curb and sidewalk at lot lines extended relative to a United States Geological Survey benchmark. No construction will be allowed to proceed except for decking, underground water and sewer, and related items until the spot survey is approved by the Building Official. This section applies to principal structures only and not to additions or accessory structures."
Section 109.2 Schedule of permit fees.
Delete all and insert "On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the Village's Annual Fee Resolution."
And insert lines (A, 1 through 3) as follows:
"A.
A fee for each plan examination, building permit and inspection shall be paid prior to the issuance of permit(s) in accordance with the following schedule:
"1.
Building permit fees are set forth in the Village's Annual Fee Resolution. Whenever the cost of construction is a factor in determining a permit or plan review fee, the valuation of building projects shall be established based on the greater of:
"a.
The cost of construction established by the International Code Council (ICC) and published on its website. The most current schedule shall be used based upon ICC published data; or
"b.
The cost of construction as stated by the applicant or agent on the application for the relevant permit.
"2.
Building plan review fees are set forth in the Village's Annual Fee Resolution. Further, an Amendment Form is required to be submitted detailing the changes for any revisions from previously approved plans. For building plans that have been previously reviewed, and the permit issued, any revisions to the building plan that, based upon the changes proposed, require the review of two or more disciplines, a plan review fee for the Amendment Form is set forth in the Village's Annual Fee Resolution.
"3.
Recovery of third-party costs. The Village may recover all third-party vendor and consultant fees incurred by the Village for plan reviews and subsequent inspections even if/when a permit is/was never issued."
Section 109.3 Building permit valuations.
Delete all and insert "The applicant for a permit shall provide a detailed estimated permit value or detailed contractor proposals at time of application. Final building permit valuations shall be in accordance with Section 14-14-1(A) through (F)."
Add (new section) 110.3.10.2 Final storm sewer inspection.
Insert "A final inspection of the storm sewer shall be scheduled with and approved by the Department of Public Works prior to the issuance of a certificate of occupancy."
Add (new section) 110.7 Final grading/TOPO survey.
Insert "If the topography of the land or property has been materially altered in connection with any work completed thereon, a final grading/TOPO plat of survey, performed, signed and sealed by a licensed land surveyor, shall be submitted to the Village for review prior to the issuance of a certificate of occupancy. The survey shall be submitted in both paper and electronic versions and shall include the location of the water meter."
Add (new section) 111.3.1 Deposit and compliance.
Insert "Prior to the granting of a temporary occupancy permit, the applicant shall submit a deposit equal to 110% of the cost of completion of all outstanding items necessitating the request for a temporary occupancy permit. The deposit shall be forfeited to the Village upon noncompletion of any outstanding items prior to the expiration of the temporary occupancy permit."
Section 112 Service Utilities.
Delete in its entirety.
Section 113 Board of Appeals.
Delete in its entirety and insert new section title 113 Appeals.
Add (new section) 113.1 General.
Insert lines (A, 1 through 3, B and C) as follows:
"A.
Any person shall have the right to appeal a decision of the Building Official to the Village Manager. A letter for appeal shall be based on a claim for one of the following three reasons:
"1.
That the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted; or
"2.
The provisions of this code do not fully apply; or
"3.
An equivalent or better method of construction is proposed.
"B.
All appeals shall be filed within 30 days of the decision of the Building Official.
"C.
The Village Manager shall affirm, modify, or reverse the decision of the Building Official."
Section 114.4 Violation penalties.
Delete all and insert "Any person who violates a provision of this code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as prescribed by law or as set forth in the Village's Annual Fee Resolution."
Section 115.3 Unlawful continuance.
Delete all and insert "Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties as prescribed by law. Violation of unlawful continuance is subject to either penalties as prescribed by law or as set forth in the Village's Annual Fee Resolution."
Add (new section) 115.4 Appeals.
Insert "Any permittee who is served with a stop-work order shall have the right to appeal the issuance of the stop-work order to the Village Manager, by filing a written appeal within seven days after the issuance of the stop-work order. The Village Manager shall, within seven days after receipt of the properly filed appeal, either (a) affirm the issuance of the stop-work order, or (b) rescind or modify the stop-work order. The failure of the Village Manager to render a decision within seven days shall be deemed as an affirmance by the Village Manager of the issuance of the stop-work order. All decisions of the Village Manager made pursuant to this Section 115.4 shall be final."
Section 202 Definitions. Fire Area.
Delete all and insert "The aggregate floor area bounded by the exterior walls of a building or structure, regardless of fire walls, fire barriers or fire-resistance-rated horizontal assemblies."
Section 406.3.5.1 Carport separation.
Delete all.
Section 420.2 Separation walls.
Delete all.
Section 420.3 Horizontal separation.
Delete all.
Add (new section) 503.1.4 Types III-B, IV, and V construction. and insert "Buildings of Types III-B, IV, and V construction are only permitted for buildings of 1,000 square feet or less in area, and of no more than one story in height. There are no area, story, height or sprinkler increases allowed for these building types as provided for in Section 506, 507 or 508. Type III-A construction is permitted in accordance with the provisions of this Code."

Section 602.3 Type III.
Delete all and insert "Type III construction is that type of construction in which the exterior walls are of noncombustible materials and the interior building elements are of any material permitted by this code. Fire-retardant-treated wood framing and sheathing complying with Section 2303.2 shall be permitted within exterior wall assemblies of a two-hour rating or less. Type III-B construction is only permitted for buildings of 1,000 square feet or less in area and no more than one story in height. Type III-A construction is permitted in accordance with the provisions of this Code."
Section 602.4 Type IV.
Delete all and insert "Type IV construction is that type of construction in which the exterior walls are of noncombustible materials and the interior building elements are of solid wood, laminated wood, heavy timber (HT) or structural composite lumber (SCL) without concealed spaces. The minimum dimensions for permitted materials including solid timber, glued-laminated timber, structural composite lumber (SCL), and cross-laminated timber and details of Type IV construction shall comply with the provisions of this section and Section 2304.11. Exterior walls complying with Section 602.4.1 or 602.4.2 shall be permitted. Interior walls and partitions not less than one-hour fire-resistance rating or heavy timber complying with Section 2304.11.2.2 shall be permitted. Type IV construction is only permitted for buildings of 1,000 square feet or less in area and no more than one story in height."
Section 602.5 Type V.
Delete all and insert "Type V construction is that type of construction in which the structural elements, exterior walls and interior walls are of any materials permitted by this code. Type V construction is only permitted for buildings of 1,000 square feet or less in area and no more than one story in height."
Section 708.1 General. Number 1
