This Article 11 (a) establishes minimum prescriptive and performance-related regulations for the design of energy efficient buildings and structures or portions thereof that provide facilities or shelter for public assembly, educational, business, mercantile, institutional, storage and residential occupancies, as well as those portions of factory and industrial occupancies designed primarily for human occupancy; and (b) regulates the design and construction of buildings for the effective use of energy, and is intended to provide flexibility to permit the use of innovative approaches and techniques to achieve the effective use of energy.
For the purpose of establishing minimum prescriptive and performance-related regulations for the design of energy efficient buildings and structures or portions thereof in the Village, the Illinois Energy Conservation Code, current edition, and all subsequent editions and amendments thereto, if any, are hereby adopted, and by this reference, incorporated as though fully set forth herein; provided, however, that the IECC is hereby amended in accordance with Section 14-11-3 of this Code.
The following items are the additions, insertions and changes to the Illinois Energy Conservation Code:
Section C101.1 Title.
Delete all and insert "These provisions shall be known as the Illinois Energy Conservation Code of the Village of Lincolnwood and shall be cited as such and will be referred to herein as 'this code.' The Village of Lincolnwood shall be inferred whenever the term 'Village' is used in this code."
Section C108.4 Failure to comply.
Delete all and insert "Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine as set forth in the Village's Annual Fee Resolution."
Section C109 Board of Appeals.
Delete in its entirety and insert new section title C109 Appeals.
Add (new section) C109.1 General.
Insert lines (A, 1 through 3, B and C) as follows:
"A.
Any person shall have the right to appeal a decision of the Building Official to the Village Manager. A letter for appeal shall be based on a claim for one of the following three reasons:
"1.
That the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted; or
"2.
The provisions of this code do not fully apply; or
"3.
An equivalent or better method of construction is proposed.
"B.
All appeals shall be filed within thirty days of the decision of the Building Official.
"C.
The Village Manager shall affirm, modify, or reverse the decision of the Building Official."
Section R101.1 Title.
