Owners and lessors of premises shall be responsible for:
A. 
Compliance with the housing standards and this Part 2 and shall remain responsible therefor, regardless of the fact that this Part 2 may also place certain responsibilities on operators and occupants, and regardless of any agreement between or among owners, lessors, operators, and occupants as to which party shall be responsible, except as provided in Subsection B of this section.
B. 
Proper maintenance, condition, and operation of service facilities. Owners and lessors shall be responsible for providing adequate heat and hot water, unless otherwise provided in a written agreement with occupants.
C. 
Independent inspections and tests of equipment and systems used in connection with such premises and for filing and maintaining reports thereof.
D. 
Posting of printed statements of the maximum number of occupants permitted in designated parts of premises.
E. 
The removal of garbage, refuse, and junk, to assure that the premises are maintained in a safe, clean, healthful, and sanitary condition, and shall provide adequate private carting for such removal. Any municipal collection which may be provided shall be supplemented by private carting service when necessary.
A. 
Maintenance of premises. Operators of premises shall be responsible for compliance with the provisions of this Part 2 and the housing standards in regard to the following:
(1) 
Limiting occupancy to the maximum number of persons permitted and prohibiting unlawful uses;
(2) 
Posting required statements of the maximum number of occupants permitted;
(3) 
Maintenance of the premises in a clean, safe, and sanitary condition;
(4) 
Maintenance and operation of service facilities in good order and condition;
(5) 
Maintenance of plumbing, heating, and electrical equipment and systems, appliances, fixtures, as well as other building equipment and facilities, in an appropriate, good, operative, clean, and sanitary condition;
(6) 
Maintenance of walls, floors, and ceilings in public places in a clean and sanitary condition;
(7) 
Keeping exits free and clear;
(8) 
Disposing of garbage, refuse, and junk in a safe and sanitary manner and keeping the premises free and clear therefrom and broom clean;
(9) 
Extermination of insects, vermin, rodents, pests, and elimination of harborage; and
(10) 
Hanging and removing of screens.
B. 
Resident superintendent on premises; reprisals.
(1) 
In every multiple dwelling containing five to 15 dwelling units, a competent superintendent or manager shall be available who shall be responsible for the conduct, operation and maintenance of such dwelling, except that, where two such dwellings under the same ownership are connected or adjoining, one such superintendent or manager shall be sufficient for both dwellings.
(2) 
In every multiple dwelling containing 15 or more dwelling units, there shall be living on the premises and regularly present there a competent superintendent or manager who shall be responsible for the conduct, operation and maintenance of such dwelling, except that, where two such dwellings under the same ownership are connected or adjoining, one such superintendent or manager shall be sufficient for both dwellings.
(a) 
During any temporary absence of such superintendent or manager, there shall be present on said premises at all times a competent English-speaking adult who is charged with the responsibility of dealing with any emergency situation that may arise.
(3) 
The superintendent's apartment number of residence and telephone number shall be posted in all buildings.
(4) 
Prohibition against reprisals.
(a) 
No owner or officer, agent or employee of an owner of a multiple dwelling shall threaten or attempt to evict, increase the rent, withhold a lease renewal, or in any other manner take reprisals against any tenant for:
[1] 
Reporting in good faith to the Department of Building and Code Enforcement the existence of any violation of this Code or any other law, local law or ordinance related to the operation or maintenance of a multiple dwelling.
[2] 
Performing his or her duties as an officer or employee of the Village of Mineola.
[3] 
Attempting to secure or enforce his or her right under his or her lease.
(b) 
No owner or officer, agent or employee of an owner of a multiple dwelling shall threaten or attempt to evict, increase the rent, withhold a lease renewal or in any other manner take reprisals against any tenant for the purpose of deterring or punishing a tenant who forms, joins, assists or sympathizes with lawful activities of a tenant organization or union.
(c) 
No action for possession of real property shall be maintained if the dominant purpose in bringing the action is reprisal. Also, no such action shall be maintained if the plaintiff attempted to increase the tenant's obligation under the lease as a reprisal and the tenant's failure to perform such additional obligation is a material reason for bringing such action. Also, no such action shall be maintained on the grounds of refusal to pay rent if the plaintiff threatened to or did decrease his or her obligations under the lease as such a reprisal and the tenant refused to pay rent because of the reprisal.
(5) 
Any person or persons failing to comply with the terms and conditions of this section shall be guilty of an offense against this section, punishable as set forth in § 300-65 of this chapter.

A. 
An occupant shall be responsible for compliance, with respect to that part of a building occupied, controlled or used by the occupant, with the housing standards in regard to the following:
(1) 
Occupancy limitations and its lawfully permitted use;
(2) 
Maintenance in a clean, safe, and sanitary condition;
(3) 
Maintenance of plumbing, cooking, and refrigeration equipment, appliances, fixtures, and facilities in a clean and sanitary condition and providing reasonable care in the operation and use thereof;
(4) 
Keeping exits free and clear;
(5) 
Disposing of garbage and refuse into provided facilities in a sanitary manner and keeping the premises free and clear therefrom;
(6) 
Keeping domestic animals and pets in an appropriate manner and under control.
B. 
No tenant or occupant shall tamper with fire-protection, heating or electrical devices.
