A Police Department is hereby established in and for the Borough of Mount Joy.
The Chief of Police shall be the chief executive of the Police Department. He shall, under the direction of the Mayor, be in charge of the police force and have supervision over its members in the exercise of their powers, duties and authority.

There is hereby established the ranks of police officer, Corporal and Police Sergeant, which shall be subordinate to the Chief of Police in the Police Department. The number of persons to serve as police officer, Corporal and Police Sergeant on a full-time and/or part-time basis, and the compensation of each, shall be as determined by Borough Council from time to time.

Prior to making an arrest under 42 Pa.C.S.A. § 8902, any police officer shall ensure that:
A. 
He/she has probable cause to believe that at least one of the following summary offenses is being committed:
(1) 
Disorderly conduct (18 Pa.C.S.A. § 5503).
(2) 
Public drunkenness (18 Pa.C.S.A. § 5505).
(3) 
Obstructing highways and other public passages (18 Pa.C.S.A. § 5507).
(4) 
Purchase, consumption, possession or transportation of liquor or malt or brewed beverages (18 Pa.C.S.A. § 6308).
B. 
The suspect's conduct is ongoing.
C. 
The conduct constituting the offense is in the officer's view.
D. 
The conduct imperils the personal security of any person or endangers public or private property.
Following an arrest pursuant to 42 Pa.C.S.A. § 8902, the officer shall forthwith satisfy the procedures set forth in Pennsylvania Rules of Criminal Procedure Rule 441, Procedure Following Arrest Without Warrant.
