The Mount Joy Borough Council establishes and may, from time to time if it so desires, alter, amend and supplement rules and regulations for the operation, use, and protection of the Borough parks. Such rules and regulations may include, but shall not be limited to, regulations of times for use of parks and for the presence of persons therein and the nature and extent of the permitted uses thereof, prohibition of activities on grass plots and in particular areas, and such other matters as Council may deem necessary or proper for the protection of the parks and persons and property therein and the orderly use thereof by the public and in the public interest.

Any person who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine not less than $5 and not exceeding $600 and costs and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this chapter continues shall constitute a separate offense.
The rules and regulations established hereunder shall be posted at a conspicuous place or places in each park to which they are applicable. Appropriate signs may be posted to direct or warn persons with respect to the rules and regulations and their operation.
No person shall do any act in a Borough park which defaces, damages or destroys any Borough property, trees, shrubs and other plantings.
All persons in public parks shall conduct themselves in an orderly manner and shall commit no nuisance or disturbance.
The playing of athletic games and athletic activities shall be confined to areas designated therefor, and no such activities shall be confined to any other areas.
The Borough Memorial Park, located at Marietta Street and South Market Street, is intended as a place of quiet and rest and is not to be used for playground purposes. No person shall carry on any games or do any acts in said park which will tend to tear or destroy the turf or any plantings.
All persons shall give full heed to all posted signs and directions with respect to conduct in the parks.

Playing golf in all Borough parks is prohibited.

All parks shall be open to the public from dawn to dusk, unless otherwise posted or permission is granted by the Mount Joy Borough Council. Certain areas may be restricted from use.

Parking: designated areas only.
Repairs: in emergencies only.
Washing, waxing, etc.: prohibited.
Operation: on roadways or specially designated areas only.
Bicycles: must be kept out of marked areas.

Possession or use of alcoholic or malt beverages in the parks is prohibited. Persons under the influence of intoxicating beverages shall not be permitted in the parks.

No animals shall be brought into the parks, except domestic animals on a leash not more than four feet in length. Any person bringing an animal into a park shall clean up after such animal.

No person shall engage in any kind of gambling at which money or other valuable things may or shall be played for, staked, or betted upon, unless otherwise specified by the Mount Joy Borough Council.

No one is permitted to build a fire, except in those areas designed for that purpose.

No one is permitted to discard any form of waste material, paper, or rubbish, except in those containers supplied for that purpose.

No person shall injure, deface, remove, cut or damage any of the trees, plants, turf, buildings, structures or fixtures therein, or any other property of the Borough located within a park.

No person shall gather or remove any wood, turf, soil, rock, sand, gravel or other materials stored at a park without written permission of the Borough.

No person shall discharge within any Borough park or Borough property any firearms, as that term is defined by § 6120(b) of the Pennsylvania Uniform Firearms Act,[2] except for the justifiable use of force as authorized by Chapter 5 of the Pennsylvania Crimes Code.[3] No person shall use or possess within any Borough park or Borough property any bow and arrow, slingshot, air rifle or any other device (other than firearms as defined above) capable of throwing any projectile of any sort, including the hand throwing of rocks or stones intended to be used as weapons. This section shall not be operative in any specific area now designated or to be designated in the future by the Borough as a rifle range, archery range, or any other specific area whose purpose is to allow the activities otherwise prohibited by this section.

No person shall use profane language within a park or conduct himself in any lewd, immoral, or commonly objectionable manner within a park or conduct himself so as to annoy any other person using a park for recreational purposes.

No person shall set up any booth, table or stand, mobile or otherwise, for the sale of any article whatsoever within the limits of a park without written permission from the Mount Joy Borough Council.
