Persons under the age of 16 years shall not be allowed on Town streets, sidewalks or in public places after 10:00 p.m., Eastern standard time or Eastern daylight saving time, whichever is applicable, except for October 31 (Halloween) after 9:00 p.m., Eastern standard time or Eastern daylight saving time, whichever is applicable, unless accompanied by a parent, legal guardian, school teacher or person who has assumed responsibility for raising said children on a permanent basis. Said curfew will cease at sunrise the following morning.
Notwithstanding § 81-1, persons under the age of 16 years may attend legitimate school functions chaperoned by school authorities or their designated agents. Persons under 16 years of age must not be on public streets, sidewalks or in public places one hour after the school functions terminate. Notwithstanding § 81-1, persons under the age of 16 years may attend legitimate church functions and recognized activities involving "scouting." The term "scouting" is to apply to all phases of girl-scouting and boy-scouting, including scouting activities for younger children. Persons under 16 years of age may not be on public streets, sidewalks or in public places one hour after church or scouting functions terminate.

Violating this chapter is a violation, not a misdemeanor. First offenses may be punished by a fine levied upon the violator of up to $50. The appropriate magistrate shall have the authority for a first offense to warn the violator without fine, if he so chooses. Second offenses within two years shall be punished by a fine in an amount no less than $50 or more than $100. Third and subsequent offenses within two years shall be punished by a fine of not less than $100 or more than $150. It shall be mandatory to impose a fine on the second and any subsequent offenses within two years.

Local police forces shall have the authority to issue an appearance ticket to the individual alleged to be in violation of this chapter.

This curfew applies to residents and nonresidents of the Town of Colton.
