Except as specifically noted otherwise in this chapter, Chs. 340 to 348, Wis. Stats., inclusive, Ch. 350, Wis. Stats., and § 23.33, Wis. Stats., describing and defining regulations with respect to motor vehicles, traffic, snowmobiles and all-terrain vehicles, for which the penalty includes a forfeiture, including procedures for prosecution, and all provisions of Ch. Trans 305, Wis. Adm. Code, describing and defining regulations relative to the equipment of vehicles, are hereby adopted and by reference made a part of this chapter as if fully set forth herein, together with any future additions, deletions or supplements thereto, and are herewith incorporated as part of this chapter and shall be enforced with the same force and effect as though set forth in full herein; provided, however, that where such rules and regulations are less stringent than other provisions found in this chapter, the provisions of this chapter shall apply. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter.

A. 
The speed limit on all Village streets shall be 25 miles per hour, unless otherwise designated by the Village Board and posted in accordance with this chapter.
B. 
Alderson Street.
(1) 
The speed limit shall be 35 miles per hour from the intersection of Ryanwood Avenue southerly to Howland Avenue.
(2) 
The speed limit shall be 25 miles per hour from the intersection of Ryanwood Avenue northerly to its intersection with Weston Avenue.
C. 
Grand Avenue/BUS HWY 51.
(1) 
The speed limit shall be 35 miles per hour from King Street northerly to its junction with Kort Street/Jelinek Avenue at the northerly jurisdictional boundary.
(2) 
The speed limit shall be 40 miles per hour from the King Street intersection to 365 feet north of Village Way Drive.
(3) 
The speed limit shall be 45 miles per hour from 365 feet north of Village Way Drive then south to the village jurisdiction at Village Way Drive.
D. 
Eagle Nest Boulevard.
(1) 
The speed limit shall be 30 miles per hour from the intersection of Grand Avenue/BUS HWY 51 to CTH XX.
E. 
Industrial Park Avenue.
(1) 
The speed limit shall be 35 miles per hour from the intersection of CTH XX to Tesch Lane.
F. 
Howland Avenue.
(1) 
The speed limit shall be 35 miles per hour from the intersection of Alderson Street easterly 660 feet to the Village jurisdiction or 125 feet east of Brolta Lane.
G. 
Shorey Avenue.
(1) 
The speed limit shall be 30 miles per hour from the intersection of Alderson Street to Cedar Park Street.
H. 
Volkman Street.
(1) 
The speed limit shall be 35 miles per hour from the southern right of way line on Everest Avenue southerly to the Military Road intersection.
I. 
Weston Avenue.
(1) 
The speed limit shall be 30 miles per hour from the intersection of Volkman Street then westerly to the Urban Street intersection.
(2) 
The speed limit shall be 35 miles per hour from the intersection of Volkman Street easterly to Wall Street.
(3) 
The speed limit shall be 25 miles per hour from the intersection of Wall Street easterly to its intersection with Alderson Street.
J. 
Creske Avenue.
(1) 
The speed limit shall be 35 miles per hour from the intersection of Market Street to Tesch Lane.

All streets, alleys and highways within the Village of Rothschild, except Business Highway 51, Highway 51 and Highway 29, shall be subject to the weight limitations set forth below:
A. 
Single-axle truck: 12,000 pounds.
B. 
Tandem-axle truck: 24,000 pounds.
C. 
Tri-axle truck: 36,000 pounds.
D. 
Gross maximum weight: 48,000 pounds.
A. 
Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, forfeit not less than $1 nor more than $200, together with the costs of prosecution, and in default of payment of the forfeiture and costs of prosecution shall be imprisoned in the county jail until said forfeiture and costs are paid, but not exceeding 90 days, provided that the minimum forfeiture for a violation of any provisions of § 524-2 of this chapter shall be $10 and the minimum forfeiture for a violation of any provisions of § 524-1 of this chapter described and defined in §§ 346.61 through 346.64, Wis. Stats., shall be $75.
B. 
The provisions of § 345.60, Wis. Stats., shall apply to adjudications of violations of any provisions of this chapter.

The operator of any vehicle involved in an accident shall, within 10 days, file with the Village Police Department a copy of the report required in § 346.70, Wis. Stats., if any. If the operator is unable to make such report, any occupant of the vehicle at the time of the accident capable of making such report shall have the duty to comply with this section. Such report shall be subject to the provisions and limitations in §§ 346.70(4)(f) and 346.73, Wis. Stats.

A. 
Penalties. The penalty for violation of any provision of Chs. 341 to 348, Wis. Stats., adopted by reference herein by § 524-1, shall be a forfeiture as hereinafter provided together with the costs of prosecution imposed as provided in §§ 345.20 to 345.53, Wis. Stats.
(1) 
Uniform offenses. Forfeitures for violation of any provision of Chs. 341 to 348, Wis. Stats., adopted by reference in § 524-1 of this chapter shall conform to the forfeitures for violation of the comparable state offense, including any variations or increases for second and subsequent offenses.
(2) 
Local ordinance violation. For a violation of any other provision of this chapter there shall be a forfeiture of not less than $1 nor more than $200, together with costs of prosecution, provided that the minimum forfeiture for a violation of any provisions in § 524-2 of this chapter shall be $10, together with costs of prosecution.
B. 
Enforcement. This chapter shall be enforced in accordance with the provisions of §§ 66.0114 and 345.20 to 345.53 and Ch. 799, Wis. Stats.
(1) 
Stipulation of guilt or no contest. Stipulations of guilt or no contest may be made by persons arrested for violation of this chapter in accordance with § 66.0114(1)(b), Wis. Stats., whenever the provisions of § 345.27, Wis. Stats, are inapplicable to such violation. The stipulation shall conform to the form contained on the uniform traffic citation and complaint under § 345.11, Wis. Stats., and may be accepted within five days of the date of the alleged violation. Stipulations may be accepted by the Village Police Department.
(2) 
Deposits. Any person stipulating guilt or no contest under § 524-1 of this chapter must make the deposit required under § 345.36, Wis. Stats., or if the deposit is not established under such statutes shall deposit the forfeited penalty as provided in the schedule established by the Chief of Police and approved by the Village Board of the Village of Rothschild. Deposits may be brought or mailed to the Police Department as directed by the arresting officer. Deposits for parking or nonmoving violations shall be mailed or brought to the Village Treasurer.
(3) 
Notice of demerit points and receipt. Every officer accepting a forfeited penalty or money deposited under this chapter shall receipt therefor in triplicate as provided in § 345.26(3)(b), Wis. Stats. Every officer accepting a stipulation under the provisions of this chapter shall comply with the provisions of §§ 343.28, 345.26(1)(a) and 345.27(2), Wis. Stats., and shall require the alleged violator to sign a statement of notice in substantially the form contained on the uniform traffic citation and complaint promulgated under § 345.11, Wis. Stats.
(4) 
Forfeitures in treasury. Any officer accepting deposits for forfeited penalties under this chapter shall deliver them to the Village Treasurer within 20 days after receipt.
(5) 
Release on own bond. The arresting officer shall release any resident of this state upon his own personal bond, without sureties, for any violation charged under the provisions of this chapter upon such person exhibiting a valid chauffeur's or operator's license to the arresting authority and signing his own personal bond swearing that he will appear in court at the time fixed for hearing of the case. Such personal bond shall be substantially the following form:

The Director of Public Works is hereby authorized and directed to procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the rules of the State Highway Commission giving such notice required by state law. Signs shall also be erected in such locations and manner as authorized by the governing body as to give adequate warning to users of the street, alley or highway in question.
The term "Wisconsin Statutes," wherever used in this chapter, shall mean the Wisconsin 1965 Revised Statutes until otherwise expressly stated in the context until otherwise provided by Chapter 1, Article I, of this Code.

A. 
A left turn is prohibited at the following:
(1) 
From the exit/entrance onto Grand Avenue (Business Highway 51) of what is now the Shopko Plaza parking lot, approximately 475 feet southwesterly from the entrance to said parking lot which is opposite Ellen Street, commonly referred to as the exit/entrance between what is now Coral Lanes and Hardees.
B. 
The Village shall cause the appropriate sign or signs to be erected at the above location(s).
A. 
All-night parking. No person shall park any vehicle on any public street or highway in the Village of Rothschild between the hours of 2:00 a.m. and 7:00 a.m. during the months of November 1 through April 1 on any day, except under circumstances described in § 346.50, Wis. Stats. Official signs in compliance with the requirements of § 349.13, Wis. Stats., shall be erected at or reasonably near the corporate limits of the Village of Rothschild on all state and county highways and connecting streets informing night motorists of the night parking regulations now or hereafter in effect in the Village of Rothschild.

B. 
Semi-tractor, trailer or truck parking. No person shall park or leave standing any semi-tractor, trailer, truck, or any combination thereof, of more than 20 feet in length or more than 10,000 pounds gross vehicle weight, on any street or alley within the Village for more than three consecutive hours. If engaged in the actual process of loading and unloading, such parking shall be limited to one hour. If a situation arises whereby parking is required in excess of the stated limit, permission to exceed such limits shall be obtained from the Chief of Police or the Police Department.

C. 
Other parking. When signs are erected in any block giving notice thereof, no person shall park a vehicle for longer than the period hereinafter specified at any time between the hours specified upon the following streets or portions of streets:
(1) 
Brown Boulevard between Business Highway 51 and First Street, not longer than one hour between the hours of 8:00 a.m. and 5:00 p.m. on any day.

D. 
Miscellaneous provisions regarding parking and traffic.
(1) 
Advertising. No person shall operate or park a vehicle on any street for the primary purpose of advertising or offering said vehicle for sale.
(2) 
Loudspeakers. No person shall operate a speaker or sound amplifier in the Village of Rothschild either from a vehicle or otherwise until specific commission from the Village Board. (See also §§ 407-8 and 422-21.)
(3) 
Public parking lots.

(a) 
No person shall park a vehicle in any public parking lot in the Village of Rothschild for more than a period of 30 minutes between the hours of 2:00 a.m. and 7:00 a.m.
(b) 
Signs. Appropriate signs shall be erected in all public parking lots giving notice of said parking restrictions.
(c) 
Emergencies. The Police Chief may authorize a vehicle to park in a public parking lot for a period in excess of 30 minutes between the hours of 2:00 a.m. and 7:00 a.m. if he determines that a bona fide emergency exists.
(4) 
Village Hall parking lot. Parking is prohibited in the Village Hall parking lot, except for Village or Village-authorized functions, between the hours of 7:00 a.m. and 9:00 p.m.

(5) 
Alleys. No person shall park a vehicle in an alley for more than a period of 30 minutes.

Commercial vehicles. Commercial vehicles, except for one pickup or van operated by the occupant of a dwelling, may not be stored or parked in residential districts.

Nonmotorized vehicles, trailers and unlicensed vehicles. No person shall park, stop, or leave standing any nonmotorized vehicle, trailer, travel trailer, or unlicensed vehicle at any time on any street, alley, sidewalk, or any public property.

A. 
The Village President or, in his absence, the Public Works Administrator or Police Chief may, when circumstances warrant it, declare a snow removal emergency and specify the duration thereof, during which emergency the streets shall be cleared for the purpose of permitting official removal of snow and ice therefrom.
B. 
Notice may be given of the snow removal emergency by any reasonable means, including newspaper publication, radio and/or television broadcast, or temporary signs.
C. 
No vehicles shall be parked, stopped, or left standing on any street or alley in the Village during the period of a declared snow removal emergency.
D. 
If any vehicle is found stopped, standing or parked upon any public street or alley within the Village during the period of a snow removal emergency, the Police Department may cause said vehicle to be towed from the street or alley. The owner of the vehicle shall not be entitled to recover possession of such vehicle until the expense and towing surcharge as set by the Village Board are paid to the Village Treasurer or the Police Department. Said surcharge shall be in addition to any other penalty imposed by law or ordinance.
E. 
Parking of vehicles is allowed off or alongside the driveway on the opposite side of the livable portion of the residence during the months of November 1 through April 1. Parking is prohibited at any time in the front yard of the livable portion of the residence. For exterior storage in residential and commercial districts, refer to Ordinance § 590-96.

F. 
Any person violating this section shall, in addition to and not in lieu of any other legal remedy, upon conviction thereof, pay a forfeiture of not less than $20 nor more than $100.

A. 
Unlicensed vehicles. No person other than authorized Village employees shall operate an unlicensed motor vehicle, as defined in § 340.01, Wis. Stats., within the boundaries of any public park located in the Village of Rothschild.
B. 
Licensed motor vehicles. No person other than authorized Village employees shall operate a licensed motor vehicle, as defined in § 340.01, Wis. Stats., within the boundaries of any public park located in the Village of Rothschild, except upon established roadways specifically marked for vehicular traffic.
C. 
Any person who shall violate any of the provisions of this section shall be subject to the penalty as provided for in Chapter 458, Snowmobiles, of this Code.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
HIGHWAY
All public ways and thoroughfares and bridges on the same. It includes the entire highway right-of-way width, not limited to the actual traveled portion, but also includes the shoulders, ditches and other areas adjacent thereto.
MINIBIKE
Any motorized vehicle primarily used for transportation or sport, including but not limited to motorcycles, off-the-road trail bikes and motorized bicycles.
MOTORIZED VEHICLE
Any self-propelled device in, upon or by which any person or property is or may be transported.
SELF-PROPELLED VEHICLE
Any motorized vehicle primarily used for off-the-road use, including but not limited to go-carts, all-terrain vehicles and all other vehicles not registered pursuant to Ch. 341, Wis. Stats., but not snowmobiles.
B. 
Operation of minibikes and self-propelled vehicles. No person shall operate a minibike or self-propelled vehicle in the Village of Rothschild in the following manner:
(1) 
At a rate of speed that is unreasonable or imprudent under the circumstances.
(2) 
In any careless way so as to endanger the person or property of another.
(3) 
While under the influence of intoxicating liquor, fermented malt beverages, narcotics or other controlled substances.
(4) 
In such a way that the exhaust of the motor makes an excessive or unusual noise.
(5) 
Without a functioning muffler.
(6) 
Upon any public highway, street or alley or upon any sidewalk or parkway in the Village of Rothschild unless such vehicle is registered as required by Ch. 341, Wis. Stats., and its operation and operator are specifically permitted to operate said vehicle by the Wisconsin Statutes.
(7) 
Upon any slide, ski or skating area, except for the purposes of serving the area or crossing the places where marked.
(8) 
Upon any lands owned, operated or leased by the Village of Rothschild.
(9) 
Upon the private property of another without the consent of the owner or lessee. Failure to post private property does not imply consent for use. Any minibike or self-propelled device shall at all times have the consent of the owner before operation of such vehicle on private lands.
(10) 
Upon a cemetery, burial ground, school or church property, without the express consent of the owner.
C. 
Liability of parent or guardian. No parent or guardian of any child under the age of 18 years shall authorize or permit such child to violate any of the provisions of this section. Any child under the age of 18 years who shall operate a minibike or self-propelled device shall be presumed to be operating said vehicle under the authority of a parent or guardian.
D. 
Penalties. Any person who shall violate this section shall, upon conviction thereof, forfeit for each offense not less than $25 nor more than $200, together with the costs of prosecution, and in default of payment of such forfeiture and costs of prosecution shall be imprisoned in the county jail, not to exceed 30 days.

A. 
Conduct prohibited. No person shall, within the Village of Rothschild, by or through the use of any motor vehicle, including but not limited to an automobile, truck, motorcycle, minibike or snowmobile, cause or provoke disorderly conduct with a motor vehicle, cause a disturbance or annoy one or more persons, or disturb or endanger the property or the safety of another's person or property.
B. 
Definition. "Disorderly conduct with a motor vehicle" shall mean engaging in violent, abusive, unreasonably loud conduct, or disturbing or endangering the property or the safety of another's person or property, or otherwise disorderly conduct, including but not limited to unnecessary, deliberate or intentional spinning of wheels, squealing of tires, revving of engine, blowing the horn, causing the engine to backfire or causing the vehicle, while commencing to move or in motion, to raise one or more wheels off the ground.
C. 
Penalty. Any person who shall violate this section shall, upon conviction thereof, forfeit for each offense not less than $25 nor more than $500, together with costs of prosecution, and in default of payment of such forfeiture and costs of prosecution shall be imprisoned in the county jail not to exceed 60 days, or in addition to or in lieu of such fine may be enjoined from engaging in such conduct in the future.

A. 
All streets listed in § 524-9 of this chapter have been classified using the functional classification criteria (based on former Ch. Trans 76, Wis. Adm. Code), updated by WisDOT in the 2022 Wisconsin Information System for Local Roads (WISLR). It shall be unlawful to fail to comply with any stop sign, regardless of street classification. Such stop signs are official stop signs as referenced under § 346.46, Wis. Stats.
B. 
Stop signs. Except when directed to proceed by a traffic officer or traffic control signal, every operator of a vehicle approaching an official stop sign at an intersection shall cause such vehicle to stop before entering the intersection and shall yield the right-of-way to other vehicles which have entered or are approaching the intersection upon a highway which is not controlled by an official stop sign or traffic signal.
C. 
Manner of stopping. Stops required by Subsection A shall be made in the following manner:
(1) 
If there is a clearly marked stop line, the operator shall stop the vehicle immediately before crossing such line.
(2) 
If there is no clearly marked stop line, the operator shall stop the vehicle immediately before entering the crosswalk on the near side of the intersection.
(3) 
If there is neither a clearly marked stop line nor a marked or unmarked crosswalk at the intersection or if the operator cannot efficiently observe traffic on the intersecting roadway from the stop made at the stop line or crosswalk, the operator shall, before entering the intersection, stop the vehicle at such point as will enable the operator to efficiently observe the traffic on the intersecting roadway.
D. 
School crossing. Every operator of a motor vehicle approaching a school crossing which is controlled by a school crossing guard shall follow the directions of the school crossing guard. If directed by the school crossing guard to stop, the operator shall stop the vehicle not less than 10 feet nor more than 30 feet from the school crossing and shall remain stopped until the school crossing guard directs the operator to proceed.
E. 
Railroad crossings. Every operator of a vehicle approaching an official stop sign at a railroad crossing shall, before proceeding on or over such crossing, stop the vehicle immediately before crossing a clearly marked stop line. If there is no clearly marked stop line, the operator shall stop the vehicle not less than 15 nor more than 50 feet from the nearest rail.
F. 
Temporary stop signs.
(1) 
Every operator of a vehicle approaching an official stop sign or official temporary stop sign erected mid-block on or in the roadway by local authorities shall cause such vehicle to stop not less than 10 nor more than 30 feet from such official sign except when directed to proceed by a traffic officer.
(2) 
As used in this subsection "mid-block" has the meaning given it in § 346.33(3), Wis. Stats.
G. 
Penalty. The Village of Rothschild adopts the provisions and penalties as indicated in § 346.49, Wis. Stats., including those penalties as specifically noted for maintenance or construction areas, utility work areas, or emergency or roadside response areas.

In areas annexed to the Village of Rothschild, the designations of arterial highways or through streets, intersections controlled by traffic control signals, and yield sign locations in existence immediately prior to annexation shall automatically be so designated and enforced by the Village upon annexation. Where speed limits have been designated and signed in exception to §§ 346.57, 346.58 and 346.59, Wis. Stats., the Village shall automatically adopt the speed limits as signed immediately prior to annexation. All other speed limits shall be as designated by this chapter and state statute. This section shall apply to all annexations, whether before or after enactment of this section.

A. 
Motor vehicles. No person shall operate a motor vehicle on any highway, street, alley, or other public way within the Village unless such person is in possession of a valid operator's license issued to the person by the State of Wisconsin Department of Transportation or another legally applicable licensing authority.
B. 
Motorcycles. No person shall operate a motorcycle on any highway, street, alley, or other public way within the Village unless such person is in possession of a valid operator's license issued to the person by the State of Wisconsin Department of Transportation or another legally applicable licensing authority that specifically authorizes the operation of motorcycles.
C. 
Penalties and enforcement of this section shall be pursuant to Village Code § 524-6.
